Based on a calendar year calculated at 260 days, this would result in <br /> an annual average dally tonnage of solid waste disposed at the ALRRF of <br /> approximately 6,154 tons per day, calculated over the entire year. To <br /> allow for seasonal fluctuations in solid waste disposal, the average daily <br /> ! tonnage of solid waste accepted in any calendar quarter shall not exceed <br /> i 7000 tons per day. Both this annual tonnage cap and the average daily <br /> tonnage cap shall be subject to adjustment as provided in this Condition <br /> i No. 4.8. During any part of the year 1999 that this permit is in effect, the <br /> annual tonnage cap shall be applied on a pro rata basis. <br /> <br />4.8.2! Beginning in the year 2001, the annual tonnage cap and the average daily <br /> tonnage cap shall be automatically increased by the Planning Department <br /> to the extent required to accommodate additional waste disposal i'esulting <br /> from any one or more of the following factors: (i) additional growth, <br /> development or economic activity in Alameda County, San Francisco, or <br /> San Ramon as determined by the California Integrated Waste <br /> Management Board's ("IWMB") annual indices, and including automatic <br /> increases in each calendar year for additional waste generated by projects <br /> approved in Alameda County, San Francisco, or San Ramon; (ii) the <br /> transfer of any solid wastes or solid waste stream from other landfills in <br /> Alameda County for any reason, including without limitation the closure <br /> of such landfills or the negotiation of new contracts providing for disposal <br /> at the ALRRF, provided that such waste streams originate in Alameda <br /> County, San Francisco or San Ramon as provided for in this permit. <br /> <br />4.8.3! Within sixty (60) days after the IWMB releases its annual indices for the <br /> previous calendar year, the operator shall provide the Planning <br /> Department with a copy of the IWMB indices, and the Planning <br /> Department shall automatically increase the annual tonnage cap and <br /> average daily cap to the extent required to accommodate additional waste <br /> disposal as set forth in Condition No. 4.8.2 above. <br /> <br />4.8.4 For the purposes of calculating automatic cap increases as provided by <br /> Condition No. 4.8.2 above, the operator may provide the Alameda County <br /> Planning Depa~,~ent with other indices or factors that support, update or, <br /> in the absence of the IWMB's indices, substitute for the IWMB's annual <br /> indices. The operator shall simultaneously provide copies of all such <br /> materials to the Cities of Livermore and Pleasanton, and representatives of <br /> the Sierra Club, the Northem California Recycling Association and <br /> Altamont Landowners Against Rural Mismanagement in addition to the <br /> County, and the County shall promptly make all such materials available <br /> to the public upon request. The Planning Department may use such <br /> indices or factors in determining appropriate increases to the annual <br /> tonnage cap and average daily cap for the purposes of calculating <br /> automatic increases to the annual tonnage cap and average daily cap but <br /> shall take no action granting an automatic cap increase based on such <br /> indices or factors any sooner than twenty-one (21) days after the receipt of <br /> <br /> 5-B <br /> Final Altamont Settlement - Exhibit B <br /> <br /> <br />
