4.3.1j During the calendar years 1999 and 2000, the mount of such waste <br /> , accepted for disposal at ALRRF shall not exceed an annual tonnage cap of <br /> . 75,000 tons per year, provided, however, that any unused portion of this <br /> annual tonnage cap in either calendar year may be "banked" for potential <br /> use during any calendar year after the year 2000 and up to the Expansion <br /> Date as prodded in Condition No. 4.3.2 below. In each of these calendar <br /> years, no more than 12,000 tons of such waste shall be accepted for <br /> disposal from outside the City and County of San Francisco, and the <br /> Counties of Alameda, Contra Costa, Marin, Naps, San Mateo, Santa Clara, <br /> Solano and Sonoma (the "Nine Bay Area Counties"). <br /> <br /> 4.3.2i During each calendar year beginning on January 1, 2001 up until the <br /> i Expansion Date, the amount of such waste accepted for disposal at <br /> ' ALRRF shall not exceed an annual tonnage cap of 60,000 tons per year, <br /> provided, however, that any unused portion of this annual tonnage cap in <br /> any calendar year may be "banked" for potential use in any subsequent <br /> year up to the Expansion Date, and further provided that the annual <br /> tonnage cap may be increased to up to 75,000 tons per year by the use of <br /> any tonnage which has been "banked" in any prior calendar year pursuant <br /> to this Condition No. 4.3. In each of these calendar years, no more than <br /> 7,500 tons of such waste shall be accepted for disposal from outside the <br /> Nine Bay Area Counties. <br /> <br /> 4.3.3~ Notwithstanding the limitations set forth in Conditions No. 4.3.1 and 4.3.2 <br /> above, additional sludges, inert waste, and special waste may be accepted <br /> for disposal at ALRRF to the extent that such additional wastes are the <br /> result of a "major event" which impacts all or part of Alameda County or <br /> the City and County of San Francisco, or both. A "major event" for <br /> purposes of this Condition No. 4.3.3 is defined as an event or occurrence <br /> which requires substantial additional disposal of sludges, inert wastes or <br /> special waste, and which is either (i) a regulatory change or order <br /> requiring the collection and disposal of soil, debris or other material from <br /> a substantial area such as numerous industrial facilities or public facilities, <br /> or (ii) a damaging event or occurrence such as a fire, earthquake, flood, or <br /> large explosion, which destroys or damages structures or facilities over a <br /> substantial area. If the "major event" is a regulatory change or order, then <br /> review and approval by the Planning Commission shall be required prior <br /> to any acceptance of additional waste pursuant to this Condition No. 4.3.3 <br /> from outside Alameda County and the City and County of San Francisco. <br /> The County shall use its best effort to schedule and conclude the Planning <br /> Commission hearing on any such proposed action within thirty (30) days <br /> following the operator's application to the County seeking approval of <br /> i such disposal. <br /> <br />4.4 Sludges, Inert Waste, and Special Waste After ALRRF Expansion.
