ADDITIONAL WORK FOR WHICH REIMBURSEMENT IS NOW SOUGHT

There has been work on this project not contemplated when the City entered into its agreements
with Greenbriar. Greenbriar has paid DeSilva Gates and others for this work and now seeks
additional reimbursement.

Additional Work Associated with PG&E's 230 kV Line Construction

PG&E completed the installation of their 230 kV underground transmission line within the
newly aligned roadway. Subsequent to the completion of the PG&E work, there was significant
ground settlement adjacent to the duct bank trench that had to be corrected by the PG&E
contractor, Mueller Pipeliners. This corrective work impacted completion of the roadway
construction resulting in a number of change orders to the original roadway contract. To date,
Mueller has reimbursed the City $136,000 to cover this extra work; however, an additional
$162,000 has been requested by the City for geotechnical consultant services, survey staking,
and additional sub-drain piping required as a result of the 230kV line repair work. The City
has sent a demand letter to Mueller Pipeliners, as well as to PG&E, to recover these additional
cOStS.

Callahan Property Frontage Improvements

The roadway contract was revised to include improvements (left turn and right turn lanes) to
serve the Katz Winery easterly of Fire Station No. 5. This work was added to the DeSilva Gates
contract because it only made sense to build these improvements at the same time as the
realigned Vineyard Avenue improvements. Michael Callahan, owner of the property, has agreed
to pay for these improvements. The current total cost for these improvements, including
consultant fees is approximately $105,700.

Other Work

Other work completed by Greenbriar Homes, not originally part of the original construction
contract, included additional storm drainage facilities and joint trench facilities (electrical and
telephone) serving roadway street lights and the sanitary sewer lift station, as well as change
orders to the original contract work due to changed conditions in the field. Much of this work
was anticipated to be completed in later phases of construction. In addition, consultant support
agreements were amended to provide the additional professional services required to complete
these improvements.

FUNDS TO BE APPROPRIATED

This project was originally budgeted at $6.6 M. As discussed above and as indicated in the
table below, there have been additional costs in completing the initial phase of Vineyard Avenue
roadway improvements. As also stated above, some of these costs will be covered by
SR 05:053
