Raymund Villanueva/IN-N-OUT Burms <br />Application for conditional use permit and development plan approval to construct a <br />new, approximately 1.,911.-square foot, fast-food restaurant with drive-through, and for <br />development plan approval for a 6,300-square foot retail building on the former Budget <br />Rent-a-Car and Guaranty R.V. Center site at 4011 Pimlico Drive, Zoning for the <br />property is PUD (Planned Unit Development) - C (Commercial) District. The Planning <br />Commission will also consider the Negative Declaration prepared for this item. <br /> <br />Mr. Iserson presented the staff report on the application for a conditional use permit and <br />development plan approval for a fast-food restaurant and drive-through, and the development <br />plan approval for a 6,300-square foot retail building located at 4011 Pimlico Drive. The <br />current existing buildings will be demolished. The In-N-Out Burger restaurant will have <br />70 indoor seats and 20 outdoor seats. Access will be provided by one driveway on Pimlico <br />across from Trader Joe's. <br /> <br />Mr. Iserson described the building architecture for the In-N-Out Burger building; no building <br />plans have been submitted for the retail building. If the restaurant business does well, the <br />retail building will probably not be constructed. Several signs are proposed for the project, a <br />30-foot pylon sign, a six-foot monument on Pimlico, three wall signs, and directional signs. <br />The signs would be internally illuminated cabinet signs and a yellow lexon arrow (their <br />logo). The site plan is being determined by the existing easements and the desire to provide <br />sufficient landscaping and to accommodate the drive-through portion of the restaurant. <br /> <br />Circulation was addressed and is believed to be adequate for traffic and pedestrian uses. The <br />traffic report concludes that the traffic generated by the project would be accommodated by <br />the existing intersections, remaining at LOS D or better. Some neighbors have indicated <br />their traffic concerns to staff. Staff feels the single driveway would improve traffic safety; <br />they do suggest that the driveway on the eastern aisle be stripped for one-way only ingress. <br /> <br />Staff has recommended the red color be toned down, however, the applicant has advised the <br />red color is their trademark color. The neon banding of red around the building is being <br />accepted by staff because of similar banding on surrounding buildings. <br /> <br />A sufficient amount of landscaping is being proposed by the applicant. <br /> <br />The major issue for staff with this project deals with the freeway-oriented pylon sign. The <br />20-foot sign, which served the previous uses, is proposed to be replaced with a 30-foot sign <br />to improve visibility. Staff questions the additional 10 feet would give the added visibility <br />due to the blockage by the Santa Rita Road overpass. They recommend the pylon sign be no <br />taller than 20 feet.
