team of Balance Hydrologics and LSA Associates, assisted City Staff in securing
environmental agency permits for the restoration of the Bernal Property Creeks. Since the
start of design work, several changes have taken place which affect the overall design.
Sycamore Creek, which intersects Mission Creek, discharges storm water flows to the Zone
7 B-2-2 channel on the Bernal Property. Sycamore Creek crosses the Applied Biosystems
property and the original creek designs assumed significant modifications to the Sycamore
Creek flows based on development of the Applied Biosystems property. Applied
Biosytem's expected building phases for future development have not taken place, and
subsequently, the anticipated modifications to Sycamore Creek in this area will not be
completed, affecting the creek system's overall design.

In addition, since July of 2003, the design plans for the Bernal Property sports field have
become more defined with the selection of MD Fotheringham, Landscape Architects, for
the design of the sports fields for the 318-acre public land referred to as the Bernal
Property.

The design changes to the channels, to be undertaken by LTD Engineering, also include
provisions to segment the work to coincide with the Greenbrier Homes Communities, Inc.
construction schedule for the Valley Avenue undercrossing improvements under the Union
Pacific Railroad. This underpass was a requirement of the residential developments on the
Bemal Property. Along with the construction of the undercrossing, the existing channel
must be relocated westerly to accommodate the dropping of the road under the railroad
tracks. The schedule for the Greenbriar work will necessitate the early construction of the
central portion of the creek restoration project, requiring modification of the design plans
and the repackaging of the construction documents by LTD Engineering.

Amendment No.1 provides for the redesign of the channels to incorporate changes
identified above and provides for the consultant to collaborate and work closely with the
firm of MD Fotheringham to create a channel system design that meets both the
contributory drainage needs and the n~eds and space requirements for the future sports
park.

SR 05:061
