..
!
(

~

Chair Cooper noted that he would like to continue the vote on the road issue in order to allow
for some additional negotiations. Mr. Iserson commented that he did not see any significantly
different options, but that a continuance would give the Commission more time to study the
proposals.

A brief discussion took place regarding the possibility of a condemnation proceeding and what
the City's exposure could he. Mr. Higdon and Mr. Iserson explained the condemnation process
and how compensation is determined.

PUBLIC HEARING REOPENED

Patrick Costanzo asked the Commission not to continue the vote because the factors in the
planning of "A" Street are not going to change. He stated that the two proposals before the
Commission are the only possibilities that exist. He suggested that if the Commission chose not
to vote on either Plan A or Plan B, that they turn the matter over to the City Council. He also
related that, as far as he is concerned, there are no more negotiations to be made. He stressed
his reasons for not wanting to have the project delayed any longer. A lengthy discussion took
place between the Commission and Mr. Costanzo regarding any additional measures that could
or could not be taken in order to compromise or further negotiate any of the disputed issues.

PUBLIC HEARING WAS CLOSED

Commissioner Kumaran noted that the Commission's recommendations to delete Condition 2b
and to accepts staff's recommendation for Condition 21 were unanimous. He, therefore,
requested staff to note this and make these changes for the next meeting.

A motion was made by Commissioner Wright reconnnending that the Commission make a
finding that the proposed water tank would not have a significant impact on the
environment and that the Negative Declaration is appropriate. The motion was not
supported and, therefore, no further action was taken.

A motion was made by Commissioner Barker, seconded by Commissioner Lutz, that the
Commission continue their vote of all issues until the next meeting.

ROLL CALL VOTE:

AYES:
NOES:
ABSENT:
ABSTAIN:

Commissioners Barker, Lutz, and Chair Cooper
Commissioner Kumaran and Wright
None
None

Planning Commission Minutes

Page 18

November 19, 1997
