<br />. <br /> <br />. <br /> <br />. <br /> <br />6. PUBLIC HEARINGS <br /> <br />a. UP-97-45/Z-97-181. Grcl! Munn <br />Application for a conditional use permit and design review approval to construct an <br />approximately 900 square foot second unit located at 2824 Foothill Oaks Terrace. Zoning for <br />the property is PUD (Planned Unit Development) - LDR (Low Density Residential) District. <br /> <br />The application for Case UP-97-45 has been withdrawn by the applicant. <br /> <br />b. UP-97-65. Robert Svmons Associates <br />Application for a conditional use permit to construct an approximately 750 square foot second <br />unit within a new 7,600 square foot single-family home located at 1441 Forenza Court. Zoning <br />for the property is PUD-AlOS/LDR (Planned Unit Development - Agriculture/Open Space/Low <br />Density Residential) District. <br /> <br />Mr. Iserson presented the staff report recommending approval of the conditional use permit, subject <br />to the conditions of the staff report. He advised that the applicant has received design review <br />approval for the residence from the Ruby Hill Architectural Review Committee. Mr. Iserson noted <br />that the proposal meets the State Law requirements for second units and that the three required use <br />permit findings can be made. <br /> <br />PUBLIC HEARING WAS OPENED <br /> <br />Pete and Marie Reuling, IS Carlyle Court, Danville, represented the application. Mr. Reuling clarified <br />that it has not been determined that his parents will be living in the second unit and at the present <br />time his parents do not plan to move there. He advised that the unit is intended to be used for guests. <br />Mrs. Reuling advised that it is not their intention to rent the unit. Mr. Reuling indicated that they are <br />in agreement with the conditions of approval. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Wright commented that the second unit is well incorporated into the design of the <br />home and in reviewing the proposed plan it was hard to distinguish it from the rest of the home. <br /> <br />A motion was made by Commissioner Wright, seconded by Commissioner Lutz, making the <br />conditional use permit findings and approving Case UP-97-65, subject to the conditions listed <br />in Exhibit "B." <br /> <br />ROLL CALL VOTE <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Commissioners Barker, Dove, Lutz, and Wright, and Vice Chair Kumaran <br />None <br /> <br />Chair Cooper <br />None <br /> <br />Resolution No. PC 97-81 was entered and adopted as motioned. <br /> <br />Planning Commission Minutes <br /> <br />Page 2 <br /> <br />October 8, 1997 <br />
