He commented that he believes it is important to coordinate the hours with <br /> <br />those enforced by the Police Department, and that exceptions could come before the Planning <br />Commission. He commented that the 7:00 a.m. starting time may be a little too early and may have <br />impacts on adjacent residents. City of Pleasanton <br />Application to consider an amendment to Chapter 18.44 of the Pleasanton Municipal Code <br />(Commercial Districts) to make liquor stores conditionally permitted uses in the Neighborhood <br />Commercial and Central Commercial Districts. <br /> <br />. <br /> <br />Mr. Iserson presented the staff report noting that the Code amendment was directed by Council and <br />came about as a result of the Bonfare Market application, and the need to correct the Code which <br />makes liquor stores permitted uses in the Neighborhood Commercial and Central Commercial <br />Districts, but requires convenience stores to be conditional uses. Practically speaking, there may be <br />little difference between a convenience store and a liquor store, yet convenience stores require a use <br />permit and liquor stores do not. He noted that notification of the Code amendment has been sent to <br />the existing liquor stores in Pleasanton and the applicant for Bonfare Market, as well as the Chamber <br />of Commerce and the Downtown Association. He advised that the applicant for Bonfare Market <br />contacted staff noting support for the Code amendment as long as the conditions placed on liquor <br />stores are reasonable, related to the use, and not arbitrary. Mr. Iserson advised that staff recommends <br />approval of Case RZ-97-05, subject to Exhibit "A" of the staff report. <br /> <br />Commissioner Lutz commented that it was his recollection that when the Planning Commission <br />considered the Bonfare Market application, the Commission only recommended that the hours be <br />reduced and that the applicant appealed this requirement. He stated that he believed that when the <br />Council considered the appeal, it also acted to prohibit the sale of hard liquor. Mr. Iserson noted that <br />this was correct. <br /> <br />In response to a question from Commissioner Lutz, Mr. Iserson advised that the City does not control <br />the number of liquor stores allowed in anyone shopping center. <br /> <br />Commissioner Dove commented that he feels his neighborhood lost the convenient location of a store <br />in the Vintage Hills Shopping Center.
