Mr. McFarling is opposed to granting Mr. Wagner the 33rd unit space. <br /> <br />~ <br /> <br />Robert Schoolcraft, 25369 Gold Hills Drive, Castro Valley, is a former tenant of the park. He <br />discussed the 1961 park map and inquired if the Commission had a copy. Mr. Schoolcraft <br />distributed an enlarged copy of the map. His issue with the map is that the map has been modified - <br />- Space 17 A has been crossed out, Space 14 has been added, several sewers have been crossed off, <br />a large mobile home existed where Space 12A is now. Mr. Schoolcraft feels that the space to be <br />eliminated should be Space 17 A which is no longer in the park. He also noted that the septic tanks <br />shown as crossed out are still in existence (causing the sink holes). Mr. Schoolcraft discussed the <br />1995 Plumbing Code details the correct procedure for abandoning and removing septic tanks. <br /> <br />Mr. Schlies rebutted the following points: Mr. Wagner gave the Commission a petition indicating <br />Mr. Wagner has significant support for his application. In response to Chair Barker's earlier <br />comments, Mr. Wagner advised Mr. Schlies that Space 11 does exist, however, it is not numbered. <br /> <br />For the record, Chair Barker stated the minutes from the previous public testimony should be <br />attached to these minutes if the issue goes to the City Council. <br /> <br />Commissioner Cooper stated he has talked with the applicant prior to the hearing. <br /> <br />PUBLIC HEARING WAS CLOSED <br /> <br />Commissioner Wright feels there are 33 spaces in the park. It is questionable whether 17 A was a <br />_ legal space back in 1961 at the time of annexation. Putting all other issues aside, Commissioner <br />Wright can concur with staff's inability to make the use permit findings and feels there should only <br />be the 32 spaces as established in 1961. He would hope common sense would prevail, that the <br />applicant would not eliminate Space 12A, and would eliminate one of the other smaller, unoccupied <br />spaces. Commissioner Wright will support a denial of the conditional use permit and allow only 32 <br />spaces. <br /> <br />Commissioner Cooper feels most of the testimony has had no bearing on the application to legalize <br />an existing condition. He stated he is personally opposed to rent control measures and feels the City <br />should take some responsibility for some of the current tension existing in this matter. The rent <br />control prohibits the owner to make the improvements wanted by the tenants and the City. <br /> <br />Commissioner Cooper's feeling is that the 33 spaces is an existing use and the difference between <br />33 and 32 spaces is negligible in terms to impact on the surrounding community. He feels it is the <br />prerogative of the applicant to state the application, he does not support expanding the scope of the <br />application at this time. He does not understand the City's cross-purpose of creating a new set of <br />people with vested rights to the property when the best use of this property would be single family <br />residentiaL This is not the best location for a trailer park. He does not see the RV use of this <br />property as being likened to a campground. Commissioner Cooper will support the application on <br />its narrow basis and approve the additional space to 33 spaces. <br /> <br />In discussion with Commissioner Wright, Commissioner Cooper stated he does not have a specific <br />problem with a recreational vehicle occupying the trailer spaces; he is willing to concede that <br /> <br />Planning Commission Minutes <br /> <br />Page 10 <br /> <br />April 9, 1997 <br />
