<br />Committee's recommendation on the legal advice of the City Attorney not to change the rules <br />regarding growth management. Otherwise, we could be subject to legal challenge. The growth <br />management plan allows the City a range of units up to 650 units per year and that over a period of <br />years, the average would fall in the median range of number and density. <br /> <br />Commissioner Cooper feels there is an issue of due process here. He feels the Planning <br />Commission's feelings and concerns are not fully presented to the City Council. He would like staff <br />to make more of an effort to present the Planning Commission's position to the City Council when <br />they are in disagreement with staff's opinions and to present all resolutions in their entirety. <br /> <br />Commissioner Wright stated he has always thought the excerpts of the Planning Commission Minutes <br />were attached to the Council staff reports. He does not feel it is Mr. Swift's position to explain why <br />there was a split vote or why some Commissioners voted one way and the remaining Commission <br />voted another. This should appear in the Minutes. <br /> <br />Chair Barker disagreed, feeling that once the Planning Commission makes a decision, staff should <br />not go back to square one and push staff's agenda. <br /> <br />Mr. Iserson clarified that the Minutes are passed along to the City Council, a discussion is given in <br />the Council staff report on the reasoning behind the Planning Commission's decision, but staff does <br />have the right to continue to disagree with the Planning Commission's action when presenting and <br />recommending to the City Council. Staff makes sure the Commission's position and actions are very <br />clearly written in the City Council staff report. <br /> <br />Commissioner Cooper commented that it is staff's responsibility to present their best judgment, but <br />on the other hand, part of the job is to give the completely history of a project.
