RESOLUTION NO. PC-2026-06 <br /> <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RECOMMENDING THAT THE CITY COUNCIL DENY THE APPEAL OF A ZONING <br />ADMINISTRATOR DETERMINATION TO DENY AN APPLICATION FOR A MINOR <br />PLANNED UNIT DEVELOPMENT MODIFICATION TO REDUCE THE REQUIRED STREET- <br />SIDE YARD SETBACK FROM 20 FEET TO EIGHT FEET TO ACCOMMODATE THE <br />CONSTRUCTION OF A DETACHED ACCESSORY STRUCTURE, LOCATED AT 1011 <br />VISTA OAKS COURT, AS FILED UNDER CASE NO. PUD-25-02M <br /> <br /> <br />WHEREAS, on December 5, 2025, Tim Nystrom of NYS Architecture, as the applicant, <br />on behalf of the property owner Terence Tung, applied for a Minor Planned Unit Development <br />(PUD) Modification to reduce the required street-side yard setback from 20 feet to eight feet to <br />accommodate the construction of a detached accessory structure located at 1011 Vista Oaks <br />Court (hereinafter “the Property”), Assessor Parcel No. 948-25-12-00, (hereinafter “the <br />Project”); and <br /> <br />WHEREAS, the subject property has a General Plan land use designation of Rural <br />Density Residential, Low Density Residential, and Open Space – Public Health and Safety; <br />and <br /> <br />WHEREAS, the subject property is zoned PUD-LDR/RDR/OS-PHS/WO (Planned Unit <br />Development – Low Density Residential/Rural Density Residential/Open Space – Public <br />Health & Safety/Wildland Overlay) District; and <br /> <br />WHEREAS, a Minor PUD Modification is subject to findings listed in Pleasanton <br />Municipal Code (PMC) Section 18.68.110.B.1 through 7 and requires Zoning Administrator <br />(ZA) approval; and <br /> <br />WHEREAS, on January 9, 2026, the Zoning Administrator denied the Project pursuant <br />to inconsistencies with the required findings listed in PMC Section 18.68.110.B.1 through 7 <br />and as outlined in Section 4 below; and <br /> <br />WHEREAS, on February 23, 2026, Tim Nystrom of NYS Architecture, as the applicant, <br />on behalf of the property owner Terence Tung, filed an appeal of the Zoning Administrator <br />determination to deny the Project; and <br /> <br />WHEREAS, pursuant to Section 65905 of the Government Code, the Planning <br />Commission held a duly noticed public hearing to consider the Project on March 25, 2026, at <br />which time all interested parties had the opportunity to be heard.
