out. A maximum of 6 to 15 employees would be on duty during any given shift. Security <br />personnel would be employed on Fr/day and Saturday nights starting at l 0:00 p.m. to check IDs. <br />Low-level recorded music would normally be played in the restaurant. No speakers would be <br />installed outside. Live bands or DJ music and dancing are proposed on Friday and Saturday <br />nights starting at 9:45 p.m. and ending at 1:00 a.m. Musicians and audio equipment would be <br />located in the rear left (southeast) comer of the lower floor of the business. Amplifiers and/or <br />speakers would be oriented to direct music towards the front of the building. An approximately <br />16 ft. by 19 ft. dance area would be located adjacent to the band/DJ area (please see the attached <br />"Music/Dancing Fl6or Plan"). Tables and chairs would be moved to accommodate the band/DJ <br />and dancing areas. <br /> <br />Proposed tenant improvements would include installing a new kitchen, bar, restrooms, tables <br />and chairs, and a gas fireplace. The applicant has incorporated into the floor plan proposed <br />changes that the building owner and applicant wish to make to the recently approved design <br />review plans (e.g., modifying the front faqade and entry door, modifying windows and doors, <br />adding a staircase in the rear patio, etc.). <br /> <br />Please see the attached written narrative for additional information on the proposed use. <br /> <br />IV. ANALYSIS <br /> <br />Restaurants that serve alcohol past 10:00 p.m. ("bars"! are conditionally permitted uses in the C- <br />C district. Conditional uses are uses that, by their nature, require individual review to ensure <br />that impacts associated with their use will be regulated and minimal. Conditional use permits <br />may be subject to appropriate conditions to ensure that any potential adverse impacts associated <br />with the use will be mitigated. <br /> <br />Land Use <br /> <br />One of the primary concerns in reviewing a conditional use permit application is the effect of a <br />proposed use on surrounding uses. The site of the proposed bar is located in a commercially- <br />zoned area of Downtown Pleasanton, containing mixed land uses including retail, office, hotel, <br />and residential uses. As discussed below, there are potential adverse impacts that could occur as <br />a result of locating a restaurant/bar with late-night hours and live bands/DJ music and dancing <br />near residential uses. In addition, staffnotes that some of the existing bars in the Downtown <br />have created problems from time to time due to disorderly patrons or loud music. However, if <br />operated as described in the applicant's written narrative and as conditioned by staff, staff <br />believes that the use would not generate or contribute to the problems associated with the other <br />Downtown bars. Staff believes that the proposed use would operate similarly to the existing <br />restaurants that serve alcohol past 10:00 p.m. that are located Downto~vn (e.g., Stacey's, Blue <br />Agave, Fernando's, and Hap's restaurants).
