DRAFT Commissioner Arkin moved to make the conditional use findings as listed in the staff report and to approve Case PCUP-129, subject to the conditions listed in Exhibit B of the staff report. Commissioner Roberts seconded the motion. Commissioner Fox did not object to the pub and outdoor patio being open until 1:00 a.m. on Friday and Saturday, but had issues with a 1:00 a.m. closing during the week. She would like an additional condition to have open/close conditions for the patio door as well. Chairperson Roberts believed that the applicants should be given a chance with respect to the operating hours and indicated that she would support a midnight closing Monday through Thursday, adding that it was already fl :00 p.m. on Sunday. Commissioner Blank noted that he would not be supportive of later hours during the week unless there was a double-door system. Chairperson Roberts noted that several establishments in the Downtown district, such as Hap's and Barone's, were already open until 1:00 a.m. Commissioner Fox would support a 1:00 a.m. closing on weekends and consider later hours after seeing how the noise affects the nearby residents. Commissioner Arkin suggested that the hours be determined by the indoor/outdoor use.
