DRAFT <br /> <br />Commissioner Arkin moved to make the conditional use findings as listed in the staff <br />report and to approve Case PCUP-129, subject to the conditions listed in Exhibit B of the <br />staff report. <br />Commissioner Roberts seconded the motion. <br /> <br />Commissioner Fox did not object to the pub and outdoor patio being open until 1:00 a.m. on <br />Friday and Saturday, but had issues with a 1:00 a.m. closing during the week. She would like an <br />additional condition to have open/close conditions for the patio door as well. <br /> <br />Chairperson Roberts believed that the applicants should be given a chance with respect to the <br />operating hours and indicated that she would support a midnight closing Monday through <br />Thursday, adding that it was already fl :00 p.m. on Sunday. <br /> <br />Commissioner Blank noted that he would not be supportive of later hours during the week unless <br />there was a double-door system. <br /> <br />Chairperson Roberts noted that several establishments in the Downtown district, such as Hap's <br />and Barone's, were already open until 1:00 a.m. <br /> <br />Commissioner Fox would support a 1:00 a.m. closing on weekends and consider later hours after <br />seeing how the noise affects the nearby residents. <br /> <br />Commissioner Arkin suggested that the hours be determined by the indoor/outdoor use. <br /> <br />Commissioner Arkin moved to make the conditional use findings as listed in the staff <br />report and to approve Case PCUP-129, subject to the conditions listed in Exhibit B of the <br />staff report, with the following modification that the eastern patio area shall close at <br />11:00 p.m. and the indoor restaurant at 12:00 midnight from Monday through Thursday; <br />and that the restaurant may remain open until 1:00 a.m. on New Year's Eve. <br />Commissioner Roberts seconded the motion. <br /> <br />ROLL CALL VOTE: <br /> <br />AYES: <br />NOES: <br />ABSTAIN: <br />RECUSED: <br />ABSENT: <br /> <br />Commissioners Arkin, Blank, and Roberts. <br />Commissioner Fox. <br />None. <br />None. <br />Commissioner Maas. <br /> <br />Resolution No. PC-2004-69 was entered and adopted as motioned. <br /> <br />DRAFT EXCERPTS: PLANNING COMMISSION MEETiNG MINUTES, December 8, 2004 Page 4 of 4 <br /> <br /> <br />
