She noted that contemporary and classic rock was <br />preferred and that the volume would be kept at an appropriate level. She added that hip-hop or <br />techno music would not be played in order to attract a slightly older crowd. She noted that she <br />carefully monitored the live bands' volume during their performances and added that it was very <br />important for the business to be considerate of the surrounding neighborhood and to ensure that <br />its patrons were kept under control as well, particularly in the outdoor dining areas. She would <br />be able to bring outdoor diners inside after the outdoor closing time. <br /> <br />In response to an inquiry by Commissioner Arkin about the operator's previous proposal to <br />locate the business at 780 Main Street, Ms. Keimard advised that she was unable to come to an <br />agreement with the owner. <br /> <br />In response to an inquiry by Commissioner Blank regarding diners under the age of 21, <br />Ms. Kennard replied that they are very careful about I.D. She noted that minors normally dined <br />with their parents or in a family group, which was a common occurrence. <br /> <br />Roy Moret, 739 Main Street/129 Sand Wedge, Walnut Creek, advised that he owned and <br />managed the Los Pilares building at 739 Main Street and supported the proposed project. He <br />strongly urged continued monitoring of the conditions if approved. He believed the conditions <br />would serve the good of the community and believed the use would be beneficial to Downtown <br />Pleasanton. He read a letter into the record from a former tenant, whom he lost in August after <br />11 years: <br /> <br />"Dear Roy, <br /> After much consideration, weighing all pros and cons, we have made the painful <br />decision not to renew our lease here at 739 Main Street when it expires on July 31. It was <br />not an easy decision to make, nor is this an easy letter to write. The pub next door <br />continues to be the one and only reason for our need to relocate our offices. The <br />conditions in the rear of the pub and in the parking lot remain unacceptable. We do <br />appreciate what you have done for us in this unfortunate situation, and we have enjoyed <br />our tenancy here. Thank you for all that you have done for us." <br /> <br />Mr. Moret noted that his tenants had experienced numerous incidences of vandalism and <br />harassment resulting from their proximity to the Union Jack Pub. He urged the Commission to <br />require an additional review upon each change of management or ownership. <br /> <br />In response to an inquiry by Chairperson Roberts about the age range of patrons at the Union <br />Jack, Mr. Moret replied that one patron who caused a disturbance was in his late 30's. <br /> <br />In response to an inquiry by Chairperson Roberts regarding the Union Jack, Ms. Kline replied <br />that she had spoken with Jeff Bretzing, Senior Code Enforcement Officer, who stated that there <br />had been police surveillance at that establishment. <br /> <br />In response to an inquiry by Commissioner Arkin, Ms. Kline confirmed that the Union Jack had <br />a conditional use permit. <br /> <br />DRAFT EXCERPTS: PLANNING COMMISSION MEETING MINUTES, December 8, 2004 Page 2 of 4 <br /> <br /> <br />
