CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-079 <br /> <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE QUITCLAIM <br />DEEDS FOR UNUSED PORTIONS OF STREET RIGHT OF WAY ALONG BUSCH <br />ROAD EASTERLY OF VALLEY AVENUE BUT RESERVING AN 8-FOOT PUBLIC <br />SERVICE EASEMENT <br /> <br />WHEREAS, <br /> <br />when Valley Avenue was extended to Stanley Boulevard, Busch Road was <br />realigned thereby creating remnant portions of street right of way in the northeast <br />quadrant of that intersection; and <br /> <br />WHEREAS, <br /> <br />these remnant portions of street right of way are not needed by the City for street <br />widening or any other public purpose, except for an 8-foot wide public service <br />easement along the northerly right of way line of the realigned Busch Road for <br />furore utilities, such as electric, telephone, fiber optic and cable; and <br /> <br />WHEREAS, <br /> <br />the street right of way portions to be vacated pursuant to Chapter 4 of Part 3 of <br />Division 9 of the California Streets & Highways Code, and then quitclaimed, are <br />described in the attached Exhibits A and C and depicted on the attached Exhibits B <br />and D, respectively; and <br /> <br />WHEREAS, <br /> <br />the vacation and quitclaim of the street right of way are conditioned upon the <br />transfer of the underlying fee interest of Exhibits A and C to the owner of Parcel C <br />of Tract 7381, Busch Property as set forth in the conditions of approval for Parcel <br />Map 8329. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />The City Manager is authorized to execute quitclaim deeds for unused portions of <br />right of way for Busch Road as described and depicted in the attached Exhibits A <br />and B to Hanson Aggregates and as described and depicted on the attached <br />Exhibits C and D to Hunter Thomwood Partners, reserving an 8-foot public <br />service easement along the northerly right of way line of the realigned Busch <br />Road, so that these properties can be transferred to the owner of Parcel C of Tract <br />7381, Busch Property. <br /> <br /> <br />
