CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-078 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />RESOLUTION VACATING UNUSED PORTIONS OF STREET RIGHT <br />OF WAY ALONG BUSCH ROAD EASTERLY OF VALLEY AVENUE <br />BUT RESERVING AN 8-FOOT PUBLIC SERVICE EASEMENT <br /> <br />when Valley Avenue was extended to Stanley Boulevard, Busch Road was <br />realigned thereby creating remnant portions of street fight of way in the northeast <br />quadrant of that intersection; and <br /> <br />these remnant portions of street fight of way are not needed by the City for street <br />widening or any other public purpose, except for a 8-foot wide public service <br />easement along the northerly fight of way line of the realigned Busch Road for <br />furore utilities, such as electric, telephone, fiber optic and cable; and <br /> <br />the street right of way to be vacated is described in the attached Exhibits A and C <br />and depicted on the attached Exhibits B and D, respectively; and <br /> <br />it is the intention of the City Council to summarily vacate this street fight of way <br />pursuant to Chapter 4 of Part 3 of Division 9 of the California Streets & Highways <br />Code as this street right of way has been superseded by relocation with the new <br />alignment of Busch Road and no property access will be cut off nor will any <br />public service easement be terminated; and <br /> <br />the vacation of this street right of way is consistent with the General Plan adopted <br />by the City; and <br /> <br />the vacation of the street right of way is conditioned upon the transfer of the <br />underlying fee interest in the properties described in Exhibits A and C to the <br />owner of Parcel C of Tract 7381, Busch Property as set forth in the conditions of <br />approval for Parcel Map 8329. <br /> <br /> <br />
