The proposed use shall substantially conform to the floor plan and narrative, Exhibit "A", <br />dated "Received September 3,1996", on file with the Planning Department, except as <br />modified by the following conditions. Minor alterations may be approved by the <br />Planning Director iffound to be in substantial conformance with this approval. <br /> <br />2. If operation of the bar or game arcade results in conflicts pertaining to parking, noise, <br />traffic, loitering, or other impacts, at the discretion of the Planning Director, this use <br />permit may be submitted to the Planning Commission for subsequent review at a public <br />hearing. If necessary, the Commission may modify or add conditions of approval to <br />mitigate such impacts, or may revoke said use permit. <br /> <br />3. The applicant shall contact the Building and Fire Departments to determine all applicable <br />requirements. The structure must be made to conform to all applicable occupancy <br />requirements, codes, and ordinances of the City. All future tenant improvements shall be <br />included as part of this condition. <br /> <br />4. If additional games beyond that proposed (3) are desired, prior City review and approval <br />is required. Such modifications shall be submitted to the Planning Director, who shall <br />refer the matter to the Planning Commission should the change in use be deemed to be <br />substantial. No adult-orientated games shall be allowed. <br /> <br />5. The applicant shall obtain all applicable City permits for the use of the subject site. <br /> <br />6. A bicycle parking plan, consistent with the Municipal Code requirements, shall be <br />submitted to the Planning Director for review and approval prior to installation of the <br />arcade games. The bicycle racks required by said approved plan shall be installed prior to <br />use of the arcade games. <br /> <br />7. Signs shall conform to the approved sign program for the shopping center. <br /> <br />8. The applicant shall maintain the area surrounding the tenant space in a clean and orderly <br />manner at all times. <br /> <br />9. In the event that nuisances are created through the operation of the bar, either within the <br />bar itself or by its patrons in the vicinity of the bar, the Planning Director may refer the <br />conditional use permit to the Planning Commission for review at a public hearing. If <br />necessary, the Planning Commission may add additional conditions of approval or may <br />revoke the conditional use permit. <br />
