The proposed use will comply with applicable <br />Building and Fire Codes. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />As conditioned, the proposed use will comply with all provisions and <br />requirements of the City's zoning ordinance. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements ofthe <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project. <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will <br />be compatible with the surrounding uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-96-56, the application of Me-N-Ed's Pizza, for a conditional <br />use permit to sell beer and wine from II :00 a.m. until II :00 p.m., Sunday through <br />Thursday, and II :00 a.m. to 12:00 midnight, Friday and Saturday, and to allow <br />video games for the Me-N-Ed's Pizza Parlor located at 4270-C Rosewood Drive <br />(Phase III of the Rose Pavilion shopping center), subject to the conditions shown <br />in Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
