<br />Resolution No. PC-96-70 <br />Page 8 <br />31. No modular newspaper dispensers shall be allowed outside of buildings within the <br />development unless the enclosure and newspaper racks match the others used on Main <br />Street. The specific design and location of the newspaper racks shall be subject to the <br />review and approval of the Planning Director prior to installation. <br /> <br />32. All demolition work, site improvements, and construction activities shall be limited to the <br />hours of 8:00 a.m. to 5:00 p.m., Monday through Saturday. All construction equipment <br />must meet DMV noise standards and shall be equipped with muffling devices. <br /> <br />33. At no time shall campers, trailers, motor homes, or any other vehicle be used as living or <br />sleeping quarters on the construction site. All such vehicles shall be removed from the <br />site at the end of each work day. <br /> <br />34. Final inspection by the Planning Department is required prior to occupancy. <br /> <br />35. If archeological materials are uncovered during grading, trenching, or other on-site <br />excavation, all work on site shall be stopped and the City immediately notified. The <br />county coroner and the Native American Heritage Commission shall also be notified and <br />procedures followed as required in Appendix K of the California Environmental Quality <br />Act. A similar note shall appear on the improvement plans. <br /> <br />36. There shall be no truck deliveries, parking lot sweeping, or garbage pick-up between the <br />hours of 10:00 pm and 6:00 am. <br /> <br />37. At no time shall balloons, banners, pennants, or other attention-getting devices be utilized <br />on the site except as allowed by Section 18.96.060K of the Zoning Ordinance for grand <br />openings or by Section 18.116.040 of the Zoning Ordinance if approved by temporary <br />conditional use permit as part of a decorating plan in conjunction with shopping center <br />promotional events. At no time shall spot lighting be used after 10:00 PM in conjunction <br />with such grand openings and/or promotional events. <br /> <br />38. Portable toilets used during construction shall be kept as far as possible from existing <br />businesses and shall be emptied on a regular basis as necessary to prevent odor. <br /> <br />39. The design review and variance approvals will lapse within one year from the date of <br />approval unless a building permit is issued and construction has commenced and is <br />diligently pursued toward completion or an extension has been approved by the City. <br /> <br />40. Prior to the issuance of a building permit, the developer shall pay the required <br />commercial development school impact fee as prescribed by State Law and as adopted by <br />the Pleasanton Unified School District. <br />
