Resolution No. PC-96-69
Page 2

2. Granting the variance will not constitute a grant of special privilege
inconsistent with the limitation on other properties classified in the same
zoning district.

The Downtown design regulations prevent the placement of the required
open space area for the three units facing Main Street. The applicants'
situation is unique and will not set a precedent as it is the first project to
include residential units on the second floor of a Main Street building
since the creation of the Downtown Design Guidelines in 1985.
Furthermore, none of the other existing apartment units fronting on Main
Street provide the required open space areas.

3. Granting the variance will not be detrimental to the public health, safety or
welfare, or materially injurious to properties or improvements in the
vicinity.

The three apartment units in question will provide adequate air and light
for the tenants. Furthermore, the Downtown location of the apartment
units is unique in that it would provide alternate locations for tenants to
fulfill any open space needs (e.g., in the plaza area of the subject property,
on the Main Street sidewalk benches, at the several nearby parks that are
within walking distance of the subject site, etc.). Furthermore, the
inclusion of open space for the three units in question would detract from
the architecture of the building and the character of the Downtown. The
lack of open space would not pose a threat to the public safety.

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON
RESOLVES THE FOLLOWING:

Section 1.

Approves Case V-96-13, the application of Branagh Development for a variance
from the Municipal Code to allow the construction of three apartment dwelling
units without the required private open space, located at 349 Main Street.

Section 2.

This resolution shall become effective 15 days after its passage and adoption.
