Granting the variance will not constitute a grant of special privilege <br />inconsistent with the limitation on other properties classified in the same <br />zoning district. <br /> <br />The Downtown design regulations prevent the placement of the required <br />open space area for the three units facing Main Street. The applicants' <br />situation is unique and will not set a precedent as it is the first project to <br />include residential units on the second floor of a Main Street building <br />since the creation of the Downtown Design Guidelines in 1985. <br />Furthermore, none of the other existing apartment units fronting on Main <br />Street provide the required open space areas. <br /> <br />3. Granting the variance will not be detrimental to the public health, safety or <br />welfare, or materially injurious to properties or improvements in the <br />vicinity. <br /> <br />The three apartment units in question will provide adequate air and light <br />for the tenants. Furthermore, the Downtown location of the apartment <br />units is unique in that it would provide alternate locations for tenants to <br />fulfill any open space needs (e.g., in the plaza area of the subject property, <br />on the Main Street sidewalk benches, at the several nearby parks that are <br />within walking distance of the subject site, etc.). Furthermore, the <br />inclusion of open space for the three units in question would detract from <br />the architecture of the building and the character of the Downtown. The <br />lack of open space would not pose a threat to the public safety. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case V-96-13, the application of Branagh Development for a variance <br />from the Municipal Code to allow the construction of three apartment dwelling <br />units without the required private open space, located at 349 Main Street. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption. <br />
