<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-96-66 <br /> <br />RESOLUTION DENYING THE APPLICATION OF JOSEPH ZUFF A FOR A MAJOR <br />MODIFICATION, AS FILED UNDER CASE PUD-90-18-2M <br /> <br />WHEREAS, Joseph Zuffa has filed an application for a major modification of the approved <br />PUD Development Plan for the Bonde Ranch subdivision to reduce the required <br />20' building to building separation and to allow building construction beyond the <br />graded building envelope for 839 E. Angela Street (Lot #22 within the Bonde <br />Ranch Development); and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - RDR, LDR, and <br />MDR (Rural Density Residential, Low Density Residential, and Medium Density <br />Residential) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of September II, 1996, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br /> <br />WHEREAS, the PUD modification and design review request are covered by the <br />Environmental Impact Report approved by the City Council for PUD-90-18; and <br /> <br />WHEREAS, the Planning Commission determined that the findings for the proposed major <br />modification to the PUD Development Plan cannot be made. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Denies Case PUD-90-18-2M, the application of Joseph Zuffa for a major <br />modification of the approved PUD Development Plan for the Bonde Ranch <br />subdivision to reduce the required 20' building to building separation and to allow <br />building construction beyond the graded building envelope for 839 E. Angela <br />Street (Lot #22 within the Bonde Ranch Development). <br /> <br />Section 2. <br /> <br />Requires that the carport be removed within 30 days and the sideyard slope bank <br />be restored to the original condition subject to the satisfaction of the City <br />Engineer and the adjacent property owner. <br /> <br />Section 2. <br /> <br />This resolution shall become effective immediately upon its passage and adoption. <br />
