<br />Resolution No. PC-96-57 <br />Page 4 <br /> <br />EXHIBIT "B" <br />Conditions of Approval <br />Case UP-96-39 and Z-96-178 <br /> <br />1. The storage yard shall substantially conform to the site plan, Exhibit "A", dated "Received <br />August 9, 1996" on file with the Planning Department, except as modified by the following <br />conditions. Minor changes to the plans may be allowed subject to the approval of the <br />Planning Director iffound to be in substantial conformance to the approved exhibits. <br /> <br />2. The conditional use permit and design review approval shall expire, with no further legal <br />force and effect, within one (I) year from the date of the Planning Commission approval. <br />The applicant may request an extension of this use permit and design review approval for <br />up to three (3) months from its expiration date. The request shall be submitted in writing to <br />the Planning Director at least two (2) months before it expires. <br /> <br />3. Within one (I) year after the effective approval date ofthis use permit, the applicant shall <br />notify the Planning Director in writing as to whether the subject business will remain on the <br />site longer than one (I) year. If the business is to remain on the site longer than one (I) <br />year, the following shall be done: <br /> <br />a. An improvement plan showing the installation of sidewalk along the Old Santa Rita <br />Road project frontage, the installation of paving under the outdoor storage area, and <br />the installation of a storm-water run-off clean-up device (an oil/water separator with <br />storm drainage or a landscape buffer strip) shall be submitted to the Planning Director <br />and City Engineer for review and approval. <br /> <br />b. The property owner shall dedicate the right-of-way necessary for the installation of a <br />separated sidewalk along Old Santa Rita Road. <br /> <br />c. All of the required improvements listed in 3.a. above shall be installed and the <br />required property dedicated defined in 3.b. above shall be completed within eighteen <br />(18) months of the effective date of this approval to the satisfaction of the Planning <br />Director and City Engineer. <br /> <br />4. The applicant shall enter plant five (5) gallon size photinia shrubs, spaced 5' 0" apart, <br />between the fence and street curb within thirty (30) days of this approval. Shrubs shall be <br />manually watered. <br /> <br />5. If operation of this use results in conflicts pertaining to parking, noise, traffic, or other <br />impacts, at the discretion of the Planning Director, this conditional use permit may be <br />referred to the Planning Commission for subsequent review at a public hearing. If <br />necessary, the Commission may modify or add conditions of approval to mitigate such <br />impacts, or may revoke said conditional use permit. <br /> <br />{end} <br />
