<br /> <br />PMC Amendments Economic Vitality Committee <br />Page 5 of 6 <br />• Public Hearings: For projects with public hearings, staff recommends that the public <br />notice requirements align with the Government Code, which decreases the noticing <br />radius from 1,000-feet to 300-feet. Additionally, newspaper publication or posting in <br />three public places within City (including at project site) is required. <br />• Mailed Project Notification: For projects requiring project notification (e.g., single- <br />family residential Design Review projects, Minor Conditional Use Permits, etc.), staff <br />recommends increasing the noticing radius from “…the surrounding property <br />owners…as determined by the Zoning Administrator” to 300-feet, aligning with the <br />requirements for public hearings. <br />• On-Site Project Notification: Codify the City policy requiring on-site project notification <br />for specific projects (i.e., projects with PC or CC public hearings or new units exclusive <br />of ADUs). <br /> <br />Appeals <br />Staff proposes a comprehensive overhaul to PMC Chapter 18.144 that rescinds the Chapter <br />and replaces it with amended procedures. The proposed amendments include clarifying <br />appeal procedures and modifying the appeal period. Staff recommends that all projects under <br />PMC Title 18 be subject to a 10-day appeal period, with project approvals becoming effective <br />on the 11th day. This recommendation will align with most neighboring jurisdictions and will <br />greatly reduce added City process time for appeals. <br /> <br />The current appeal period is a minimum of 15-days, but it may last over 30-days due to PMC <br />Section 18.144.010 (B), which delays the appeal period until ZA and PC actions can be <br />reported to the City Council at its next regular meeting. Rather than a City Council agenda <br />report item of Zoning Administrator and Planning Commission actions (and Planning <br />Commission agenda report item of all actions of the Zoning Administrator), a weekly approval <br />memo will be posted to the City’s website for projects approved by both the Zoning <br />Administrator and Planning Commission. The intent of the approval memo is to publicize all <br />appealable Planning discretionary approvals within the appeal period. City Council members, <br />Planning Commissioners, and members of the public can subscribe to the memo to stay <br />apprised of appealable discretionary approvals. All appeals and City Council call-ups must <br />occur within the 10-day appeal period window. <br /> <br />Other amendments <br />Modifications to several other PMC Chapters are proposed in order to align with the appeal <br />and notice requirements to PMC Chapter 18.12 (Noticing), PMC Chapter 18.20 (Design <br />Review), and PMC 18.144 (Appeals) described above. <br /> <br />NEXT STEPS <br />Staff will take the following steps to implement the PMC amendments: <br />• Present the recommendations and zoning changes to the Planning Commission on <br />October 22, 2025, for their recommendation to the City Council. <br />• Present the recommendations and zoning changes to the City Council in December. <br /> <br />EVC INPUT <br />The EVC is invited to ask questions and provide feedback on the information presented. <br />
