The proposed location ofthe conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The project, as proposed and conditioned, requires the use to be operated <br />in a non-nuisance manner. The self-defense/martial arts studio will not <br />alter in any way the approved exterior of the building so as to detract from <br />its development standards. Sufficient parking and traffic capacity have <br />been provided. Streets leading to the site are designed per City standards <br />and are signalized to provide safe access into and out of the site. The <br />conditions of approval of the use permit will ensure that the establishment <br />remains within the standards of all applicable City codes. Other similar <br />uses in the City have not caused any problems. If all the conditions of <br />approval are complied with, the proposed self-defense/martial arts studio <br />will not detrimentally impact the surrounding businesses or residences. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />The site's PUD-C-C zoning conditionally permits the establishment of <br />self-defense/ martial arts studios. In addition, the proposed use complies <br />with all relevant sections of the zoning ordinance. Granting a conditional <br />use permit to the applicant would be consistent with the City's ability to <br />regulate zoning as listed in the Municipal Code Chapter 18.124. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed conditional use is <br />compatible with the surrounding uses. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-96-29, the application of Kathy Goodwin for a conditional use <br />permit to establish a self-defense/martial arts studio within an existing building <br />located at 3037 Hopyard Road, Suite D, within the Hopyard Village Shopping <br />Center, subject to the conditions shown in Exhibit "B," attached hereto and made <br />part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
