The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />As proposed, the secondhand store will not alter in any way the approved <br />exterior of the building so as to detract from its development standards. In <br />addition, the secondhand store will not interfere with surrounding uses' <br />ability to operate. The proposed store would be located on the ground <br />floor and would add to the economic vitality and diversity of the shopping <br />center, possibly contributing patronage to other businesses. Also, the <br />proposed use will have adequate off-street parking to meet project <br />demand. The secondhand store would only allow merchandise deliveries <br />during business hours, which would reduce possible adverse impacts on <br />the adjacent tenants. A condition also requires that the exterior of the store <br />remain free of drop-off items at all times. The store would not subject <br />surrounding uses to heavy truck traffic, hazardous conditions, or other <br />objectionable influences. As conditioned, the proposed use will be <br />compatible with adjacent retail and office uses located within the building. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />The site's PUD-C-C zoning conditionally permits the establishment of <br />secondhand stores. In addition, the proposed use complies with all <br />relevant sections of the zoning ordinance. Granting a conditional use <br />permit to the applicant would be consistent with the City's ability to <br />regulate zoning as listed in the Municipal Code Chapter 18.124 <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed conditional use is <br />appropriate for the site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section I. <br /> <br />Approves Case UP-96-28, the application of DeAnn Taylor for a conditional use <br />permit to operate a consignment shop (secondhand store) within an existing <br />building located at 3037 Hopyard Road, Suite L, within the Hopyard Village <br />Shopping Center, subject to the conditions shown in Exhibit "B," attached hereto <br />and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
