<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-96-43 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF A MODIFICATION TO THE <br />DEVELOPMENT AGREEMENT FOR THE BERNAL CORPORATE PARK <br /> <br />WHEREAS, Bernal Avenue Associates has applied for an amendment to the Development <br />Agreement to extend the term by seven years, from October I, 1998, to October I, <br />2005, for the Bernal Corporate Park (formerly the Koll Center Pleasanton) located <br />on the west side of Valley Avenue between Bernal Avenue and the Arroyo del <br />Valle; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 12, 1996, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, the extension of the term of the development agreement is a minor land use <br />regulation for which no environmental assessment is required, and the project <br />itself, which would not change, was the subject of a CEQA process at the time of <br />its initial approval as well as at the major modification stage; and <br /> <br />WHEREAS, the Planning Commission determined that the extension to the Development <br />Agreement would be appropriate and provide the developer the assurance that the <br />remainder of the park can develop as nicely as that which has developed to date. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Recommends approval of the application for Bernal Avenue Associates for an <br />amendment to the Development Agreement to extend the term by seven years, <br />from October I, 1998, to October I, 2005, for the Bernal Corporate Park <br />(formerly the Koll Center Pleasanton) located on the west side of Valley Avenue <br />between Bernal A venue and the Arroyo del Valle. <br /> <br />Section 2 <br /> <br />This resolution shall become effective immediately upon its passage and adoption. <br />
