Resolution No. PC-96-38 Page 4 EXIDBIT "B" Conditions of Approval Case UP-96-26 I. The proposed use shall conform substantially to the project description, floor plan, and licensing information, "Exhibit A," dated "Received May 17, 1996," on file with the Planning Department, except as modified by these conditions. 2. If the operation of the use results in major conflicts pertaining to parking, noise, traffic, or other impacts, at the discretion of the Planning Director, this conditional use permit may be referred to the Planning Commission for subsequent review at a public hearing. If necessary, the Commission may modifY or add conditions of approval to mitigate such impacts, or may revoke the said conditional use permit. 3. If additional activities beyond that proposed in the written narrative, dated "Received May 17, 1996, n on file with the Planning Department are desired, prior City review and approval are required. Such modifications shall be submitted to the Planning Director, who shall refer the matter to the Planning Commission if determined to be substantial. 4. Only two licensed massage therapists shall be allowed to operate under the subject use permit. The applicants shall submit written confirmation that all massage therapists have met all requirements of the Pleasanton Police Department. 5. The hours of operation for Health In Touch and Advanced Body Therapeutics shall be limited to Monday through Friday from 8:00 a.m. to 8:30 p.m., Saturday 8:30 a.m. to 6:00 p.m., and on Sunday from 10:00 a.m. to 3:00 p.m. Minor changes to the hours of operation may be submitted for the review and approval by the Planning Director. 6. The applicant shall obtain all building and other applicable City permits for the use and structure prior to the commencement of the use. 7. This use permit is not transferable to another address. A new application must be made if the applicant relocates to another site. 8. No signage for the business is approved as part of this application. Any signage shall conform to the previously-approved sign program for the building and shall be subject to the review and approval of the Planning Director prior to installation. 9. No massage therapist may operate until the required Police Department approvals and registrations are obtained. Such registrations shall remain in effect as long as the business is in operation. { end}
