The proposed use shall conform substantially to the project description, site plan, and <br />floor plans, Exhibit "A," dated "Received April 26 and May 6, 1996," on file with the <br />Planning Department, except as modified by these conditions. <br /> <br />2. If the operation of the use results in major conflicts pertaining to parking, noise, traffic, or <br />other impacts, at the discretion of the Planning Director, this conditional use permit may <br />be referred to the Planning Commission for subsequent review at a public hearing. If <br />necessary, the Commission may modify or add conditions of approval to mitigate such <br />impacts, or may revoke the said conditional use permit. <br /> <br />3. If additional activities beyond that proposed in the written narrative, dated "Received <br />April 26, 1996," on file with the Planning Department are desired, prior City review and <br />approval are required. Such modifications shall be submitted to the Planning Director, <br />who shall refer the matter to the Planning Commission if determined to be substantial. <br /> <br />4. The hours of operation of the theatre productions shall be 8:00 p.m. to 10:30 p.m., Friday <br />and Saturday and 1:00 p.m. to 5:00 p.m. on Sunday. Minor changes to the hours of <br />operation may be submitted for the review and approval by the Planning Director. <br /> <br />5. The use shall be conducted entirely within the building at all times, and the doorways to <br />the theatre shall remain closed except for entering and exiting the site or for the purpose <br />of loading/unloading activities. <br /> <br />6. The applicant shall obtain all building department and other applicable City permits for <br />the theatre operation and structure prior to the commencement of the use. All code <br />requirements pertaining to exiting, occupancy, handicap access, and related matters shall <br />be met to the satisfaction of the building and fire departments prior to issuance of any <br />permits. <br /> <br />7. This use permit is not transferable to another address. A new application must be made if <br />the applicant relocates to another site. <br /> <br />8. No signage for the business is approved as part of this application. Any signage shall <br />conform to the previously-approved sign program for the building and shall be subject to <br />the review and approval of the Planning Director prior to installation. <br /> <br />9. One address shall be used for the entire tenant space. That address shall be 1048 <br />Serpentine Lane, Suite 303. <br /> <br />[end] <br />
