Resolution No. PC-2025-10 <br />Page Two <br /> <br /> <br /> <br /> <br /> <br />Section 3: Findings for Conditional Use Permit Approval <br />With respect to the approval of P24-0421, the Planning Commission makes the following <br />findings as required by Section 18.124.070 of the Pleasanton Municipal Code: <br /> <br />A. That the proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which the <br />site is located. <br /> <br />Some of the objectives of the zoning ordinance are to: foster a ha rmonious, convenient, <br />workable relationship among land uses, protect existing land uses from inharmonious <br />influences and harmful intrusions, and to ensure that public and private lands ultimately <br />are used for the purposes which are most appropriate and ben eficial to the City as a <br />whole. The subject site is regulated by Ordinance No. 1010 (PUD-81-25), which <br />generally follows the uses of the Pleasanton Municipal Code’s (PMC) C-S (Service <br />Commercial) District. An expanded list of permitted/conditionally permitted land uses, <br />beyond those of the C-S District, was also approved as part of the original PUD. <br />Microbreweries are permitted uses in the C-S District. Over the years, through the PUD <br />Modification process, the original PUD approval was modified several times. These <br />modifications added several new permitted/conditionally permitted land uses to the <br />PUD, most recently PUD-81-25-12M, which allows brew pubs as a conditionally <br />permitted use, and subject to the approval of a CUP. The new microbrewery and brew <br />pub would operate as a standalone facility on its own parcel and would be located in an <br />area comprised of a variety of both commercial and light industrial/office type uses that <br />would not be negatively impacted by the proposed use. The closest residential uses are <br />approximately 850 and 1,300 feet away to the west and east, respectively. The <br />proposed use is unlikely to generate any significant noise impacts or result in a <br />substantial change in ambient noise levels on sensitive receptors in the area given the <br />existing noise levels generated by the other surrounding commercial, office, and light <br />industrial uses, as well as the traffic and train noise generated in the area by the nearby <br />Stanley Boulevard, Bernal Avenue, and train tracks. Patrons’ voices and possibly <br />amplified music would primarily be the newly added noise sources into the area from <br />the subject site. The proposed hours of operation for both the indoor and outdoor areas <br />would be Sunday through Thursday from 11 a.m. to 10 p.m. and Friday through <br />Saturday from 11 a.m. to 11 p.m. While not included in the current project narrative, it is <br />reasonable to expect that lightly amplified music could occur on -site (indoor and/or <br />outdoor) from time to time and/or during special events. The proposed use would be <br />subject to conditions of approval, such as keeping windows and doors closed to the <br />extent possible when not being used for ingress/egress and also to encourage patro ns <br />to not loiter on-site after operating hours. The proposed use is also conditioned to <br />comply with the City’s noise regulations. Accordingly, noise from the proposed use <br />would not significantly impact areas/uses located adjacent to or near the subject site. <br />Therefore, as conditioned, the proposed microbrewery and brew pub would be <br />consistent with the applicable land use regulations and the Planning Commission <br />believes this location is suitable for the proposed use to operate without any adverse <br />Docusign Envelope ID: FAF97CD7-AB31-442B-8140-E29B00129772
