<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-96-l9 <br /> <br />RESOLUTION DENYING THE APPEAL OF THE ZONING ADMINISTRATOR'S <br />DENIAL OF AN APPLICATION FOR DESIGN REVIEW, AS FILED BY WADE <br />MCCLURE FOR BOSTON MARKET UNDER CASE AP-96-02 <br /> <br />WHEREAS, the Zoning Administrator denied Case Z-96-23, the application of Wade McClure <br />for Boston Market for the relocation of the existing awnings to the exterior facade <br />ofthe pedestrian arcade (covered walkway) and the installation oflights for <br />Boston Market located at 3901 Santa Rita Road, Suite B; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C (Commercial) <br />District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the decision was <br />appealed by the applicant; and <br /> <br />WHEREAS, at their duly noticed public hearing of April I 0, 1996, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed relocation of the awnings <br />from above the storefront windows to the front of the pedestrian arcade is <br />inconsistent with the unified design of the center and that the proposed installation <br />of floodlights to illuminate the relocated awnings would not be consistent with the <br />previous determination to subdue the lighting in this portion of the center so as <br />not to negatively impact the adjacent residents. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Secti on 1. <br /> <br />Denies Case AP-96-03, the application of Wade McClure for Boston Market <br />appealing the decision of the Zoning Administrator's denial of an application for <br />design review to relocate the existing awnings to the exterior facade of the <br />pedestrian arcade (covered walkway) and the installation of lights for Boston <br />Market located at 3901 Santa Rita Road, Suite B. <br /> <br />Section 2. <br /> <br />This resolution shall become effective immediately upon its passage and adoption. <br />
