ORDINANCE NO. 2301 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> AMENDING SECTION 5.28.080 SYSTEM OF ASSESSMENTS TO PERMIT CHANGES <br /> TO THE MANNER IN WHICH THE ANNUAL ASSESSMENT IS LEVIED WITHIN THE <br /> DOWNTOWN PLEASANTON BUSINESS IMPROVEMENT DISTRICT, AND TO LEVY <br /> THE ANNUAL ASSESSMENT FOR 2026 <br /> WHEREAS, under and pursuant to the provisions of the Parking and Business <br /> Improvement Area Law of 1989, Section 36500 et seq. of the California Streets and Highways <br /> Code (-89 Law"), on September 16, 2025, the City Council of the City of Pleasanton ("City") <br /> adopted Resolution No. 2025-055, titled"A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF PLEASANTON, ACCEPTING AND APPROVING THE 2025 ANNUAL REPORT AND 2026 <br /> BUDGET OF THE DOWNTOWN PLEASANTON BUSINESS IMPROVEMENT DISTRICT, <br /> DECLARING THE INTENTION TO AMEND PLEASANTON MUNICIPAL CODE SECTION <br /> 5.28.080 SYSTEM OF ASSESSMENTS TO PERMIT CHANGES TO THE MANNER IN WHICH <br /> THE ANNUAL ASSESSMENT IS LEVIED, AND TO LEVY THE ANNUAL ASSESSMENT FOR <br /> 2026"; and <br /> WHEREAS, Resolution No. 2025-055 was duly published, and copies of Resolution No. <br /> 2025-055 were mailed to the affected businesses, as required by the 89 Law; and <br /> WHEREAS, as specified in Resolution No. 2025-055, a public hearing concerning the <br /> formation of the Downtown Pleasanton Business Improvement District ("District") was held before <br /> the City Council on November 4, 2025 at 7:00 p.m. in the City Council Chamber of the City of <br /> Pleasanton, located at 200 Old Bernal Avenue, Pleasanton, California 94566; and <br /> WHEREAS, pursuant to the 89 Law, a determination is made that there has been no <br /> finding of a majority protest against the proposed District by the City Council following said public <br /> hearing. A "majority protest", pursuant to California Streets and Highways Code Section 36525, <br /> would have consisted of written protests received from the business owners which will pay <br /> 50% or more of the proposed assessment; and <br /> WHEREAS, based in part on recommendations of the Pleasanton Downtown Association, <br /> and the stated purpose of the District to support economic vitality, the District will continue to <br /> support businesses in the Downtown; and <br /> WHEREAS, the District assessments are to be modified to expand business support <br /> through new events and community programming, beautification and placemaking programs, and <br /> business recruitment and retention initiatives, and to provide a stable funding source for the <br /> District. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. The City Council hereby establishes a business improvement area to be <br /> named "Pleasanton Downtown Business Improvement District" and levies the annual assessment <br /> for 2026. <br /> SECTION 2. The boundaries of the District are Del Valle ParkwayNervais Drive/Ray <br /> Street to the north, Bernal Avenue to the south, First Street to the east, and Peters Avenue/Old <br /> Bernal Avenue to the west, as shown on the map attached as Exhibit A. <br />
