The Client Obligations: <br />A.City of Pleasanton will pay the Artist for the work performed as outlined above in Section <br />5.<br /> <br />B.City of Pleasanton shall agree to provide, pay for and be responsible for: <br />i.Setting the supporting mechanism (footings) that will be used to attach the Artwork to <br />Delucchi Park site.<br /> <br />ii.Ensure that the Artist is granted sufficient access to the project site as may be <br />required during the time of the installation of the Artwork.<br /> <br />iii.Any inspections, fees, permitting and plan checks as required by any governmental <br />agency, including but not limited to, the City of Pleasanton.<br /> <br />iv.City of Pleasanton shall be solely responsible for any permitting or approvals that may <br />be required by the City of Pleasanton for the installation of the Artwork.<br /> <br />v.An identification plaque listing Title, Date, Artist’s Name, Materials and incidental <br />descriptive text.<br /> <br />C.If the installation of the artwork and/ or the transfer of title to the Artwork is delayed under <br />any agreement made between City of Pleasanton and transferee that results in a delay of <br />the performance of this agreement, City of Pleasanton will extend the schedule of this <br />agreement, without penalty to the Artist, with an equal and commensurate period of time.<br /> <br />D.City of Pleasanton shall be solely responsible for compliance with all applicable federal, <br />state, and local laws and government regulations relating to the installation of the Artwork <br />on the Delucchi Park Site, including without limitation the U.S. Americans with Disabilities <br />Act, all fire department regulations and requirements, and public safety requirements.<br /> <br />E.After installation is completed, City of Pleasanton shall be responsible for all maintenance <br />of the Artwork, provided that City of Pleasanton shall determine the nature and level of <br />maintenance in its sole discretion.<br /> <br />F.City of Pleasanton will credit the Artist in all interpretive signage and promotional <br />materials that they generate to feature the artwork and/or the project.<br /> <br />G.City of Pleasanton will credit the Artist in all public statements on social media and/or in <br />print in all materials that they generate to feature the artwork and/or the project.<br /> <br />ARTWORK COMMISSIONING AGREEMENT page 10 <br />Docusign Envelope ID: 1E0CB645-5270-47AA-87EB-8D8E57759177Docusign Envelope ID: 04C40C7C-1D5C-40F8-AB54-E2C7D9B79ACC
