3 <br />b) Each August, City shall provide Masters with the new Team Rental Rates (Exhibit <br />A) for the following year (September 1 through August 31). <br /> <br />c) Invoicing and payment. City shall invoice Masters monthly, and Masters shall pay <br />City within 30 days. The City may deny Masters use of the DBAC for any <br />nonpayment. <br /> <br />i) Any swim meets and pre-approved special events shall be invoiced <br />separately by City based on rates in Exhibit A, as may be annually <br />amended. <br /> <br />5) Masters Use of Other Areas at DBAC. <br /> <br />a) During the terms of this Agreement, City will allow Masters to use two cabinets <br />located on the 50-meter pool deck which must remain clean and organized to the <br />City's standards; no equipment shall remain on the 50-meter pool deck unless <br />approved in advance by the City. <br /> <br />b) With advanced permission from City, Masters coaching staff may be provided <br />agreed upon office access at the DBAC for day-use only during a swim meets. <br /> <br />c) With advanced permission from City, City copy machine in the DBAC is <br />available for minimal use by Masters coaches to make black and white copies <br />during swim meets. Bulk copying shall be completed elsewhere at Masters own <br />cost. <br /> <br />6) Conditions of Use. Masters use of the DBAC is also subject to the Conditions of Use set <br />forth in Exhibit D. <br /> <br />7) Lifeguards. <br /> <br />a) Masters shall not use lifeguards who are employed by City to work directly for or <br />volunteer for Masters at the DBAC. Masters may only use City lifeguards when <br />Masters is paying City for lifeguard services, and City lifeguard employees are <br />scheduled by City. <br /> <br />b) Masters coaches shall be solely and fully responsible for providing lifeguarding <br />services to all TVMers when TVMers are within the DBAC pursuant to this <br />Agreement. <br /> <br />i) Lifeguard services are defined as follows: The attendance of one or more <br />lifeguards who possess a current certificate from the American Red Cross, and <br />are trained to administer first aid, including, but not limited to, <br />cardiopulmonary resuscitation.
