<br />Resolution No. PC-96-l1 <br />Page 4 <br /> <br />EXHIBIT "B" <br />UP-95-81 <br />PLANNING COMMISSION <br />CONDITIONS OF APPROVAL <br /> <br />1. The proposed use shall conform substantially to the site plan, floor plan, written narrative, <br />and related materials, Exhibit A, dated "Received December 15, 1995," and "Received <br />January 16, 1996," on file with the Planning Department, except as modified by these <br />conditions. <br /> <br />2. Any changes to signage shall conform to the eXlstmg approved comprehensive sign <br />program for the Arbor office/flex complex, and shall be subject to the approval of the <br />Planning Director. <br /> <br />3. The use permit may be reviewed by the Planning Director at any time to determine if <br />additional conditions of approval are necessary to ensure continued compatibility with <br />surrounding uses with respect to parking, traffic, noise, compliance with state and/or <br />federal laws, or other impacts. At the discretion of the Planning Director, this use permit <br />may be referred to the Planning Commission for subsequent review at a public hearing to <br />add such conditions or, if deemed necessary, to revoke the subject use permit. <br /> <br />4. The applicant shall obtain all applicable City permits prior to improvements to and <br />operation of the subject use permit. <br /> <br />5. The health club facility shall open no earlier than 5:00 a.m. Monday morning and close no <br />later than 11 :00 p.m. on Friday evening. The hours of operation on Saturday and Sunday <br />shall be no earlier than 7:00 a.m. and no later than 11 :00 p.m. <br /> <br />6. The management of the health club facility shall inform all patrons utilizing the facility <br />between the proposed hours of 11 :00 p.m. and 6:00 a.m. during any day of the week, that <br />they are required to park only in the front parking area immediately in front of the building <br />along West Las Positas Boulevard. All patrons utilizing the facility between the hours of <br />6:00 a.m. and 8:00 a.m. and 5:00 p.m. and 11 :00 p.m. during any day of the week, are <br />required to park on the front portion of the site between the street frontage along West Las <br />Positas Boulevard and the entrance to the aerobics room along the east side of the building. <br />Patrons utilizing the facility between the hours of 8:00 a.m. and 5:00 p.m. may utilize the <br />entire parking lot area. The management of the facility is responsible for enforcing the <br />parking requirement by periodically monitoring the lot, and if any noise grievances cannot <br />be worked out between the gym and the surrounding neighbors, the gym will agree to <br />terminate its 24 hour operation at this site. <br /> <br />7. Any modification in the operation of or any expansion of the use shall require subsequent <br />review by the Planning Director, who may approve the modification if it is judged to be <br />minor, or may refer it to the Planning Commission for review if found to be a substantial <br />change. <br /> <br />--..--....---.----.----- .--.....-.-----..------.-....-.- <br />
