Resolution No. PC-96-l1 Page 4 EXHIBIT "B" UP-95-81 PLANNING COMMISSION CONDITIONS OF APPROVAL 1. The proposed use shall conform substantially to the site plan, floor plan, written narrative, and related materials, Exhibit A, dated "Received December 15, 1995," and "Received January 16, 1996," on file with the Planning Department, except as modified by these conditions. 2. Any changes to signage shall conform to the eXlstmg approved comprehensive sign program for the Arbor office/flex complex, and shall be subject to the approval of the Planning Director. 3. The use permit may be reviewed by the Planning Director at any time to determine if additional conditions of approval are necessary to ensure continued compatibility with surrounding uses with respect to parking, traffic, noise, compliance with state and/or federal laws, or other impacts. At the discretion of the Planning Director, this use permit may be referred to the Planning Commission for subsequent review at a public hearing to add such conditions or, if deemed necessary, to revoke the subject use permit. 4. The applicant shall obtain all applicable City permits prior to improvements to and operation of the subject use permit. 5. The health club facility shall open no earlier than 5:00 a.m. Monday morning and close no later than 11 :00 p.m. on Friday evening. The hours of operation on Saturday and Sunday shall be no earlier than 7:00 a.m. and no later than 11 :00 p.m. 6. The management of the health club facility shall inform all patrons utilizing the facility between the proposed hours of 11 :00 p.m. and 6:00 a.m. during any day of the week, that they are required to park only in the front parking area immediately in front of the building along West Las Positas Boulevard. All patrons utilizing the facility between the hours of 6:00 a.m. and 8:00 a.m. and 5:00 p.m. and 11 :00 p.m. during any day of the week, are required to park on the front portion of the site between the street frontage along West Las Positas Boulevard and the entrance to the aerobics room along the east side of the building. Patrons utilizing the facility between the hours of 8:00 a.m. and 5:00 p.m. may utilize the entire parking lot area. The management of the facility is responsible for enforcing the parking requirement by periodically monitoring the lot, and if any noise grievances cannot be worked out between the gym and the surrounding neighbors, the gym will agree to terminate its 24 hour operation at this site. 7. Any modification in the operation of or any expansion of the use shall require subsequent review by the Planning Director, who may approve the modification if it is judged to be minor, or may refer it to the Planning Commission for review if found to be a substantial change. --..--....---.----.----- .--.....-.-----..------.-....-.-
