<br />Resolution No. PC-96-1O <br />Page 6 <br /> <br />EXHIBIT "B" <br />PUD-81-30-59D <br />PLANNING COMMISSION <br />CONDITIONS OF APPROVAL <br /> <br />1. Development shall be substantially as shown on the development plans, Exhibit <br />"A", dated "Received February 6,1996" on file with the Planning Department, <br />except as modified by the following conditions. Minor changes to the plans may <br />be allowed subject to the approval of the Planning Director if found to be in <br />substantial conformance to the approved exhibits. <br /> <br />2. No building permits may be issued until the final parcel map is recorded which <br />subdivides this 20-acre parcel from the remainder of Lot 60 of Hacienda Business <br />Park (Assessor's Parcel Number 941-2779-4-1). <br /> <br />3. Prior to recordation of the final parcel map, the developer and property owner <br />shall enter into agreements to segregate any assessments proportionately to each <br />parcel. Said segregation shall be reviewed and approved by the City Attorney and <br />City Engineer prior to recordation. <br /> <br />4. All conditions of Case PUD-8l-30-24M (change of zoning designation from <br />PUD-I/C-O to PUD-HDR, approved in December 1991) shall remain in full force <br />and effect. <br /> <br />5. This development plan shall be of no further validity and the developer shall be <br />required to submit the same or new development plan for City approval prior to <br />development of the site in the event that any of the following occur: <br /> <br />a. The developer fails to receive growth management approval within <br />2Y2 years ofPUD approval, or <br />b. Subsequent to such approval, the developer allows the growth <br />management approval to lapse. <br /> <br />6. Should the City Council decide to acquire Lot 60 for a neighborhood or <br />community park site or a portion thereof greater than the proposed remainder of <br />approximately 6 acres within three months of the date of this approval, this <br />development plan approval shall become null and void. <br /> <br />7.
