<br />Resolution No. PC-96-09 <br />Page 4 <br /> <br />EXHIBIT "B" <br />Proposed Conditions of Approval <br />Case PUD-81-30-61D <br />Arby's Restaurant <br />(February 14, 1996) <br /> <br />PLANNING <br /> <br />1. Development shall be substantially as shown on the development plans and colorboard, <br />Exhibit "A", dated "Received February 2, 1995" on file with the Planning Department, <br />except as modified by the following conditions. Minor changes to the plans may be <br />allowed subject to the approval of the Planning Director if found to be in substantial <br />conformance to the approved exhibits. <br /> <br />2. Should the City's Traffic Engineer determine that traffic circulation problems have been <br />created due to the installation of only one entrance off Chabot Drive, the second driveway <br />entrance, required driveway aisle, and frontage landscaping shall be installed to the <br />satisfaction of the City's Traffic Engineer and Planning Director. <br /> <br />3. A supplemental traffic study shall be prepared for any future development on the <br />remainder of the site if the City's Planning Director and Traffic Engineer determines that <br />said development changes the traffic assumptions contained within the traffic study <br />prepared by TJKM, dated March 14, 1995, for the Arby's restaurant. <br /> <br />4. Prior to building permit issuance for any sign, a final sign plan be submitted to the <br />Hacienda Owner's Association and the Planning Director for review and approval. In <br />general, the sign plan shall reduce the size of the Arby's lettering and logo on the <br />monument signs in accordance with the peer review architect's letter dated January 30, <br />1996 and height of the wall signs shall be approximately 30 inches. The sign plan shall <br />also include the actual material samples for the proposed signs and the design of the <br />reader boards for the drive-through restaurant. <br /> <br />5. If operation of the drive-through land results in conflicts pertaining to parking, noise, <br />traffic, or other impacts, at the discretion of the Planning Director, this conditional use <br />permit may be referred to the Planning Commission for subsequent review at a public <br />hearing. If necessary, the Commission may modify or add conditions of approval to <br />mitigate such impacts, or may revoke said conditional use permit. <br /> <br />6. The applicant shall maintain the area surrounding the restaurant in a clean and orderly <br />manner at all times. <br /> <br />7. All restaurant facilities shall be equipped at all times with filtering devices to minimize <br />odors and fumes. <br />
