If necessary, the Commission may modify or add <br />conditions of approval to mitigate such impact, or may revoke the use <br />permit. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public heath, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The proposed floor plans indicate that each of the workstations would be <br />in the direct line-of-sight of employees. In order to discourage the <br />viewing of adult-oriented material, a condition of approval requires that <br />employees regularly monitor the programs being used by the patrons and <br />prevents tenant improvements which would create private booths around <br />the work stations. The Police Department is in support of this <br />recommended condition of approval. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />Chapter 18.124 of the Zoning Ordinance states that, because of their <br />unusual characteristics, conditional uses require special consideration so <br />that they may be located properly with respect to their effects on <br />surrounding properties. The recommended conditions of approval will <br />help to integrate the proposed use into the Mission Plaza without <br />detrimentally affecting the surrounding properties or the City in general. <br />As conditioned, the proposed use will comply with all provisions and <br />requirements of the City's zoning ordinance. <br /> <br />WHEREAS, projects ofthis nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed use, as conditioned, will <br />be compatible with the surrounding uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-95-83, the application of Comet CyberCentre for a conditional <br />use permit to operate amusement devices at 1991 Santa Rita Road, Suite "E", <br />subject to the conditions shown in Exhibit "B," attached hereto and made part of <br />this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br /> <br />---,,-- <br />
