<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-96-02 <br /> <br />RESOLUTION DENYING THE APPLICATION OF CONNOLLY DEVELOPMENT <br />COMPANY TO AMEND THE DEFINITION OF "BAR" IN THE PLEASANTON <br />MUNICIPAL CODE, AS FILED UNDER CASE RZ-95-06 <br /> <br />WHEREAS, Connolly Development Company has submitted an application to amend the <br />definition ofa "bar" as stated in Section 18.08.027 of the Pleasanton Municipal <br />Code and modify Table 18.44.090 -- Permitted and Conditional Uses -- to allow <br />restaurants located in the CoN Neighborhood Commercial zoning districts to sell <br />alcoholic beverages after 10:00 p.m. upon approval ofa Conditional Use Permit; <br />and <br /> <br />WHEREAS, at their duly notice public hearing of January 10, 1996, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects ofthis nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that the proposed amendment would have <br />potential impacts on the surrounding neighborhoods, and, therefore, is <br />inappropriate. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Denies Case RZ-95-06, the application of Connolly Development Company to <br />amend the definition ofa "bar" as stated in Section 18.08.027 of the Pleasanton <br />Municipal Code and modify Table 18.44.090 -- Permitted and Conditional Uses-- <br />to allow restaurants located in the CoN Neighborhood Commercial zoning <br />districts to sell alcoholic beverages after 10:00 p.m. upon approval of a <br />Conditional Use Permit. <br /> <br />Section 2. <br /> <br />This resolution shall become effective immediately.. <br />
