<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-97-96 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF JANET <br />BURTON FOR APPROVAL OF A CONDITIONAL USE PERMIT AND PUD PLAN <br />APPROVAL, AS FILED UNDER CASE UP-97-96 AND PUD-97-13 <br /> <br />WHEREAS, Janet Burton has applied for 1) Planned Unit Development (PUD) plan approval to <br />construct an approximately 1,750 square foot single-family dwelling and related <br />site improvements on an approximately 0.50 acre site, and 2) conditional use <br />permit approval to establish a secondary unit within the existing 800 square foot <br />dwelling located at 570 Sycamore Road; and <br /> <br />WHEREAS, zoning for the property is PUD-A (planned Unit Development - Agriculture) <br />District; and <br /> <br />WHEREAS, at its duly noticed public hearing of December 10, 1997, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the City <br />staff concerning this matter; and <br /> <br />WHEREAS, an Environmental Impact Report was prepared and certified for the North <br />Sycamore Specific Plan, and the California Environmental Quality Act specifies <br />that individual residential development projects that are prepared pursuant to the <br />requirements of an adopted specific plan, for which an EIR has been prepared and <br />certified are exempt from additional environmental review; therefore, no <br />environmental document was prepared for this application; and <br /> <br />WHEREAS, the Planning Commission made the following conditional use permit findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br /> <br />The request to establish a detached secondary unit on the site conforms with the <br />objectives and purposes of the zoning ordinance. A secondary unit is considered <br />to be a single-family use which is allowed in the PUD-A district. The secondary <br />unit would be consistent with the rural/agricultural character of the area because <br />farm employee housing and secondary units already exist in the area. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />
