Ordinance No. 2298 <br /> Page 5 of 7 <br /> 9. Tree planting or median landscaping. <br /> 10. Remodeling, repair or reconstruction of a structure damaged by fire, flooding, <br /> wind, earthquake, or other calamity. <br /> C. The value of the artwork will be an amount not less than one-half of one <br /> percent (0.5%) of the development project's permit valuation (exclusive of land). <br /> §13.20.040 In-lieu Fee. <br /> As an alternative to the contribution requirement contained in section 13.20.030, a <br /> developer may pay an in-lieu fee. The in-lieu fee shall be established and adopted by <br /> the city council from time to time by resolution. <br /> §13.20.050 Criteria. <br /> A. Public art shall be subject to the following criteria: <br /> 1. No unpermitted obstruction or encroachment in the public right of way shall <br /> be permitted. <br /> 2. The materials used for the public art shall be structurally sound and weather <br /> resistant. <br /> B. The following may not be used to satisfy the contribution requirement <br /> contained in section 13.20.030: <br /> 1. Art objects which are mass-produced from a standard design; <br /> 2. Reproductions of original artworks; <br /> 3. Decorative, ornamental, or functional elements including details and <br /> fenestration of a building which are designed by the project architect as <br /> opposed to an artist commissioned for the purpose of creating the artwork; or <br /> 4. Landscape architecture and landscape. <br /> C. Unless given prior approval from the Director of Community Development <br /> installation of public art shall be on or within the project site. <br /> §13.20.060 Approval Process. <br /> A. Application. An applicant seeking approval of a project subject to the <br /> requirements of this chapter shall submit a public art application, as established by the <br /> city council, to the planning department, generally at the same time as the application <br /> for planning approval, or in instances where no planning approval is required, at the <br /> time of building permit. The application will include the preliminary construction and <br /> alteration cost of the project, a description of the proposed public art, budget for design, <br />
