ORDINANCE NO. 2298 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ADDING <br /> A NEW CHAPTER 13.20 TO TITLE 13, PUBLIC ART CONTRIBUTION TO THE <br /> MUNICIPAL CODE OF THE CITY OF PLEASANTON <br /> WHEREAS, public art amplifies the cultural landscape of a community, offering City <br /> residents and visitors access to artistic expressions that reflect City values, history, and identity; <br /> and <br /> WHEREAS, there is a community interest in expanding and supporting the existing and <br /> future body of public art in the City of Pleasanton within non-residential sites, including providing <br /> funding for the acquisition, installation, maintenance, and other supporting activities to sustain <br /> the inventory of public art; and <br /> WHEREAS, on August 20, 2024, the City Council of the City of Pleasanton provided <br /> direction to City staff to further explore a public art contribution requirement for the City of <br /> Pleasanton; and <br /> WHEREAS, on March 3, 2025, the Civil Arts Commission of the City of Pleasanton <br /> received information on similar art contribution programs and provided feedback to City of <br /> Pleasanton's proposed art contribution program; and <br /> WHEREAS, an addition to the Pleasanton Municipal Code is necessary to require a <br /> public art contribution for non-residential projects. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Chapter 13.20 to Title 13 of the City of Pleasanton's Municipal Code is <br /> hereby added as set forth in the attached Exhibit A. <br /> SECTION 2. The City Council finds that adoption of this Ordinance is exempt from <br /> CEQA because: (i) it is not a project within the meaning of Public Resources Code, section <br /> 21065 because it has no potential to alter the physical environment; (ii) and pursuant to CEQA <br /> Guidelines section 15061(b)(3), the so-called "common sense" exemption, for this same reason. <br /> SECTION 3. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in "The Valley Times," a newspaper of general circulation published in <br /> the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the <br /> City Clerk's office within fifteen (15) days after its adoption. <br /> SECTION 4. This ordinance shall be effective thirty (30) days after its passage and <br /> adoption. <br />
