<br />Resolution No. PC-97-91 <br />Page 3 <br /> <br />EXHIBIT B <br /> <br />Conditions of Approval <br />Case Z-97-262/ Barone's Restaurant <br />Temporary Tent over Existing Restaurant Dining Deck! <br />Temporary Parking Lot <br /> <br />1. The tent shall be substantially as shown on the development plans, Exhibit" A", dated <br />"Received October 8, 1997" on file with the Planning Department, except as modified <br />by the following conditions. Minor changes to the plans may be allowed subject to the <br />approval of the Planning Director if found to be in substantial conformance to the <br />approved exhibits. <br /> <br />2. This approval is valid for the period from November 27, 1997 through February 28, <br />1998. Should the applicant desire to erect a similar structure during the winter months in <br />subsequent years, a new submittal for design review shall be required to be submitted to <br />the Planning Commission each year, unless determined otherwise upon review of a <br />permanent parking lot plan at a subsequent hearing. The applicants shall apply for such <br />approval within six months of the date of this hearing. <br /> <br />3. All requirements of the Fire and Building Departments shall be complied with at all times <br />and all required City permits shall be obtained prior to erection of the tent. <br /> <br />4. The temporary parking lot shall be constructed using a minimum of 6 to 8 inches of <br />compacted asphalt grindings installed not more than 3 inches below the existing grade. <br />The parking lot shall be designed to drain to the street or other approved stormwater <br />outlet. Grading shall be kept to the minimum necessary to achieve such drainage. The <br />final drainage! grading plan shall be submitted for the review and approval by the Planning <br />Director and Chief building Official prior to the issuance of a permit. Precast concrete <br />wheel stops shall be used at the end of each parking space. The temporary parking lot <br />improvements shall be completed within 45 days of this approval. <br /> <br />5. A tree report by a certified arborist shall be completed to identify the minimum distance <br />around the tree which shall remain undisturbed. The pavement plan shall be modified as <br />necessary in order to adhere to the recommendations of this report. A copy of the report <br />shall be provided for the review and approval by the Planning Director prior to the <br />issuance of a permit. The arborist shall submit a written statement to the Planning <br />Director upon completion of these parking lot improvements evaluating the project's <br />compliance to the report's recommendations. <br /> <br />{end} <br />
