Contract #2025331 <br />First Amendment Page 1 <br />FIRST AMENDMENT TO AGREEMENT <br />This First Amendment to Agreement ("First Amendment") is entered into this 14th day of July <br />2025 by the City of Pleasanton ("City") and Water Resources Economics, LLC ("Consultant”) <br />Whereas, on September 5, 2024, the City and Consultant entered into a Professional <br />Services Agreement for Water and Sewer Rate and Connection Fee Studies as identified in RFP <br />PWD 24.603 ("Agreement"); and <br />Whereas, the parties desire to amend the Agreement to extend the Agreement Term and <br />provide increased compensation for additional services. <br />Now, therefore, in exchange for valuable consideration, the receipt of which is hereby <br />acknowledged, the parties agree as follows: <br />1.Section 1 of the Agreement, "Consultant Services" is amended to read: <br />The scope of services described in Exhibit A of the Agreement has been expanded to <br />include the following additional services: <br />a. Conduct separate technical analysis for water and sewer programs instead of <br />combined. ($12,400) <br />b. Provide six technical memorandums that describe the technical analysis for <br />both the water and sewer financial plan, rate structure, and final rates/fees. <br />These technical memorandums will be used by City to support the City <br />Council staff reports. ($1,700 each; $10,200 total) <br />c.In-person attendance and presentation at five additional City Council meetings <br />related to sewer rates and connection fees. ($9,320 each; $46,600) <br />d.Video conference attendance at City Council Water Road Show to assist staff <br />in preliminary information sharing of water rate structure topics. ($5,750) <br />e.Contingency for additional staff requested technical analysis and meetings <br />($12,000) <br />The tentative timeline described in Exhibit A has been modified as follows: <br />Water Program <br />a.Council Meeting: Financial Plan Scenarios - 3/4/25 <br />b.Council Meeting: Rate Structure - 5/6/25 <br />c.Council Meeting: Rates, Connection Fees, and Drought Rates - 6/3/25 <br />d.Water Rate Study Final Report – 6/25/25 <br />e.Council Meeting: Prop 218 Notice Approval – 7/15/25 <br />f.Council Meeting: Adopt Rates/Fees – 10/7/25 <br />g.Water Rates Effective – 1/1/26 <br />Sewer Program <br />a.Council Meeting: Financial Plan Scenarios – 10/21/25 <br />b.Council Meeting: Rate Structure – 11/18/25 <br />c.Council Meeting: Rates and Connection Fees – 12/16/25 <br />d.Sewer Rate Study Final Report – 1/2/26 <br />e.Council Meeting: Prop 218 Notice Approval – 1/20/26 <br />f.Council Meeting: Adopt Rates/Fees – 4/7/26 <br />g.Sewer Rates Effective – 7/1/26 <br />Docusign Envelope ID: 90505986-D6AB-46A0-83B8-2F22C15F40FA
