Development shall be substantially as shown on the development plans, Exhibit "A", dated <br />"Received August 1, 1997" on file with the Planning Department, except as modified by <br />the following conditions. Minor changes to the plans may be allowed subject to the <br />approval of the Planning Director if found to be in substantial conformance to the <br />approved exhibits. <br /> <br />2. Approval of this use permit for stockpiling fill material on the site does not entitle the <br />applicant to any future development of the site beyond or in addition to that accorded <br />with the zoning and General Plan land use designations. Approval of the use permit in no <br />way implies any approval of a development plan. Nor does it guarantee the applicant a <br />particular grading plan for any future development plan submitted for review. <br /> <br />3. Any future development plan for the site shall be reviewed on its own merits and fill <br />material placed on this site through use permit approval may be required to be regraded, <br />recontoured, or even removed if deemed necessary to achieve the best development plan <br />possible. <br /> <br />4. No fill may be placed within ten feet of the trunks of existing trees. Prior to issuance of a <br />grading permit, construction fencing shall be erected at a minimum ten foot diameter <br />around every tree. All tree protection fencing shall remain in place until all grading and <br />construction/relocation of structures is completed. <br /> <br />5. Prior to the issuance of grading permits, the grading plan shall be modified to reflect the <br />following: <br /> <br />a. No fill slopes shall exceed a 3:1 maximum slope. <br /> <br />b. All relocated or new access roads through the fill site areas shall be indicated on <br />the final grading plan and any grading necessary to accommodate them shall be included <br />as part of the final grading plan. No new roadway slopes shall exceed 15%. <br /> <br />6. The developer shall submit a final grading and drainage plan prepared by a licensed civil <br />engineer depicting all final grades and on-site drainage control measures, including <br />existing and new catch basins, concrete-lined Y -ditches to protect all cut and fill slopes <br />from surface water overflow. This plan shall be subject to the review and approval of the <br />City Engineer and/or the Director of Building Inspection prior to the issuance of any <br />building permits. <br />
