FIRST AMENDMENT TO AGREEMENT <br />This First Amendment to Agreement ("First Amendment") is entered into this lst day of July 2025 by <br />the City of Pleasanton ("City") and Pleasanton Unified School District ("PUSD") <br />Whereas, on July I,2024, the City and PUSD entered into an agreement for joint use of the <br />Middle School Gymnasiums ("Agreement"); and <br />Whereas, the terms and scope of work need to be amended; and <br />'Whereas, the parties desire to amend to the Agreement; <br />Now, therefore, in exchange for valuable consideration, the receipt of which is hereby acknowledged, <br />the parties agree as follows: <br />Recital F of the Agreement, is amended to read: <br />The City and District wish to clarify use of the Middle School Gymnasiums for Fiscal <br />Year 2025126. <br />Section 2a of the Agreement, "Term" is amended to read: <br />The term of this Agreement is from July 1, 2025 to lune 30,2026. <br />Sectiqn 3 of the Agreement, "Costs" is amended to read: <br />ii. $40.00 per hour (Monday-Friday); $60,00 per hour (Saturday); and $80.00 per hour <br />(Sunday) for custodial obligations related to maintaining the Middle School Gymnasiums <br />and sur¡ounding areas. <br />iii. one-half of the costs of regular maintenance, repair, and upkeep of the Middle School <br />Gymnasiums. Gymnasiums will be utilized by Amador and Foothill High School for a <br />period of time inthe2025126 school year. The City's maintenance costs will <br />be prorated for only the period the gym is used by the Cify. <br />3.
