<br />Resolution No. PC-97-63 <br />Page 3 <br /> <br />EXHmlT A <br />Conditions of Approval <br />Amendment to the <br />Stoneridge Regional Shopping Center Development Agreement <br />July 23, 1997 <br /> <br />1. The draft Development Agreement dated <br />the following: <br /> <br />shall be modified to include <br /> <br />a. Section 1 and Appendix C shall be modified to reflect the proposed expansion of <br />202,000 square feet, not the previously proposed 220,000 square feet, such that <br />additional future Floor Area shall be 380,000 square feet. Corresponding changes to <br />other exhibits shall also be made to conform all tables to the revised total floor area. <br /> <br />b. A new section shall be added to amend the original Section 3.2(c) to add the <br />following: <br /> <br />"Additional Traffic Improvements as used herein shall specifically mean <br />mitigation measures identified by the City to offset anticipated traffic <br />impacts should it decide not to construct the West Las Positas <br />interchange. Furthermore, Developer agrees that, as to the additional <br />202,000-square foot expansion approved herein, no use of this floor <br />area will be made until completion of the West Las Positas study or <br />three years from the adoption of this amendment, whichever comes first, <br />and, should City determine as a result of the study, due to the inability to <br />satisfactorily mitigate traffic on North Pleasanton intersections, to <br />impose a freeze on new development applicable to properties not vested <br />as of the date of this Agreement which contribute traffic to Stoneridge <br />Drive at I-680, Developer's ability to develop the 202,000-square foot <br />expansion shall cease unless City, in light of the then-adopted land use <br />policies, allows this or some other expansion. " <br /> <br />c. Add a second new section or subsection incorporating the following: <br /> <br />I. The developer acknowledges that the City is not guaranteeing that existing LOS <br />standards be maintained in perpetuity and that no guarantee is made the City will <br />be responsible for keeping those intersections at LOS D or better. <br /> <br />2. The developer shall commit to implement a proactive Transportation Systems <br />Management program or other measures which will positively mitigate the <br />project's otherwise anticipated traffic impacts. <br />
