<br />PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-97-55 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF EDWARD KOHL, AS FILED UNDER <br />CASE UP-97-35 <br /> <br />WHEREAS, Edward Kohl has applied for a conditional use permit to construct a 780 square <br />foot second unit within an approximately 7,500 square foot, two-story <br />single-family home located at 1310 Galanti Court (Ruby Hill); and <br /> <br />WHEREAS, zoning for the property is PUD (planned Unit Development) - NOS/LDR <br />(Agriculture/Open Space, Rural Density Residential) District; and <br /> <br />WHEREAS, at its duly noticed public hearing ofJune 25, 1997, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations ofthe City <br />staff concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which the site <br />is located. <br /> <br />The request to establish a second unit within the existing residence conforms with <br />the objectives and purposes of the zoning ordinance and the purpose of the Ruby <br />Hill PUD. State law considers second units as a single-family use. The proposal <br />will maintain the existing single-family character of the Ruby Hill development <br />because the unit is designed as part of the home, indistinguishable from the exterior <br />as a second unit. <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious to the properties or improvements <br />in the vicinity. <br /> <br />Due to the limited size of the second unit, and its proposed use for extended stay <br />visitors, traffic generated by use of the unit should not be significantly greater than <br />that of a single-family residence and may even be less given the unit's potential for <br />limited use under the current property-owner. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br />
