<br />Resolution No. PC-97-46 <br />Page 5 <br /> <br />8. No smoking is allowed in the restaurant or in the outdoor dining area. <br /> <br />9. The applicant shall maintain the area surrounding the restaurant/wine bar in a clean and <br />orderly manner at all times. The applicant shall be responsible for and shall monitor the <br />area outside of the restaurant/wine bar to ensure peace and quiet. <br /> <br />10. In the event that nuisances are created through the operation of the bar, either within the <br />bar itself or by its patrons in the vicinity ofthe bar, including the parking lot, the <br />Planning Director may refer the conditional use permit to the Planning Commission for <br />review at a public hearing. If necessary, the Planning Commission may add additional <br />conditions of approval or may revoke the conditional use permit. <br /> <br />II. If operation of this use results in conflicts pertaining to parking, noise, traffic, or other <br />impacts, at the discretion of the Planning Director, this conditional use permit may be <br />referred to the Planning Commission for subsequent review at a public hearing. If <br />necessary, the Commission may modify or add conditions of approval to mitigate such <br />impacts, or may revoke said conditional use permit. <br /> <br />12. The restaurant/wine bar shall include a contained area for cleaning mats, containers, and <br />equipment. The wash area shall be covered or shall be designed to prevent runoff onto or <br />from the area. The area shall be connected to the sanitary sewer, subject to approval by <br />DSRSD, or shall be collected in a containment area and removed regularly by a disposal <br />and recycling service. If connected to the sanitary sewer, a structural control such as a <br />sand filter or oil/ water separator shall be used, and a sign shall be posted prohibiting the <br />dumping of hazardous materials. Other methods may be used subject to the approval of <br />the Director of Building Inspection. The applicant shall instruct employees to conduct all <br />washing activities in this area. <br /> <br />13. All restaurant facilities shall be equipped at all times with filtering devices to minimize <br />odors and fumes. <br /> <br />14. The applicants shall effectively screen from view all new ducts, meters, air conditioning <br />equipment, and any other mechanical equipment, whether on the structure, on the ground, <br />or on the roof, with materials architecturally compatible with the main structure. <br />Screening details shall be shown on the plans submitted for issuance of building permits, <br />the adequacy of which shall be determined by the Planning Director. All required <br />screening shall be provided prior to occupancy. <br /> <br />15. All mechanical equipment shall be constructed in such a manner that noise emanating <br />from it will not be perceptible beyond the property plane of the subject property in a <br />normal environment for that zoning district. <br />
