<br />Resolution No. PC-97-43 <br />Page 2 <br /> <br />In order for this finding to be made, there must be a relationship between the <br />unique site and the variance in question. The lot shape and development pattern <br />restricts the placement of a new building at the rear of the property. The <br />applicants' lot is unique and the granting of the subject variance will not set a <br />precedent. <br /> <br />3. Granting the variance will not be detrimental to the public health, safety or <br />welfare, or materially injurious to properties or improvements in the vicinity. <br /> <br />The proposed storage building would complement the design and materials of the <br />existing buildings on the site. If built to all applicable codes, the proposed storage <br />building would not affect the health, safety, or general welfare of the surrounding <br />area. The ample separation of the storage building from the neighboring <br />structures mitigates any visual or air space impacts on these properties. The <br />proposed building would also meet the FAR and height regulations of the zoning <br />district, which are designed to control the overall mass and height of structures on <br />a property. There is no knowledge of any specific opposition to the proposed <br />building by the adjacent property owners. Therefore, the granting of the variance <br />would not be detrimental to the public health, safety, or general welfare or <br />materially injurious to properties in the area, and staff is able to make this third <br />finding. <br /> <br />WHEREAS, projects ofthis nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this application; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed storage building and <br />monument sign will be compatible with the adjacent buildings on the site and in <br />the surrounding neighborhood and are appropriate for the site, and that the <br />variance from the Municipal Code is appropriate in that it will allow the <br />development as proposed. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case Z-97-58/Z-97-88N-97-03UP-96-86 and Z-96-257, the <br />application of CSB Construction/Ray's Electrical for I) design review approval to <br />construct an approximately 4,350 square foot storage building to be located <br />behind the existing 3730/3732 Stanley Boulevard building and design review <br />approval for a new monument sign, and 2) a variance from the Municipal Code to <br />allow the proposed storage building to encroach into the required rear yard <br />setback, located at 3724-3732 Stanley Boulevard, subject to the conditions shown <br />in Exhibit "B," attached hereto and made part ofthis case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
