<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-97-42 <br /> <br />RESOLUTION DENYING CASE AP-97-03, AND RECOMMENDING APPROVAL <br />OF THE APPLICATION OF PATRICK CURRIN FOR A PUD MODIFICATION, AS <br />FILED UNDER CASE PUD-85-15-3M <br /> <br />WHEREAS, the Zoning Administrator approved Case PUD-85-15-3M, the application of <br />Currin Construction for a minor modification to PUD-85-15 (Golden Eagle Farm) <br />to eliminate the private pedestrian trail system amenity from the open space area <br />of the Golden Eagle Farm - Phase 2 (west side of Foothill Road) subdivision <br />located at 1780 Foothill Road; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the City Council of <br />Pleasanton appealed the decision; and <br /> <br />WHEREAS, zoning for the property is Planned Unit Development (PUD) - Low Density <br />Residential (LDR) District; and <br /> <br />WHEREAS, at its duly noticed public hearing of May 14, 1997, the Planning Commission, <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project; and <br /> <br />WHEREAS, the Planning Commission determined that the replacement of this private on-site <br />trail with a comparable amenity chosen by the Golden Eagle Farm homeowners <br />association would satisfy the intent of providing private amenities in new <br />subdivisions and is in the best interests of the residents of this development. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Denies Case AP-97-03, and recommends approval of Case PUD-85-15-3M, the <br />application of Currin Construction for a modification to PUD-85-15 (Golden <br />Eagle Farm) to eliminate the private pedestrian trail system amenity from the <br />open space area of the Golden Eagle Farm - Phase 2 (west side of Foothill Road) <br />subdivision located at 1780 Foothill Road, subject to the conditions listed in <br />Exhibit "B" attached hereto and made a part ofthis case by reference. <br />
